«Գալաքսի» ընկերությունների խմբի հայտարարությունը Դատախազության հաղորդագրության առթիվ

Ս.թ. օգոստոսի 30-ին դատախազության կողմից տարածվել է հայտարարություն, որում անդրադարձ է կատարվում «Գալաքսի» ընկերությունների խմբում հանդես եկող, Երևանի սիրված սրճարաններից մեկի՝ «Սանտաֆե»-ի տարածքի օգտագործման առնչությամբ նախաձեռնված քրեական վարույթի մասին, որն առերևույթ կարող է շփոթմունք առաջացնել հանրության շրջանում և թյուր պատկերացում ձևավորել։


Մասնավորապես, դատախազության հայտարարությամբ վիճարկվում է 2017թ. Երևանի Կենտրոն վարչական շրջանում հողամասի վարձակալության և սեփականության իրավունքների ձեռքբերման գործընթացի իրավաչափությունը։ Այնինչ, հարկ է նշել, որ դեռևս 2001 թվականից սրճարանի տարածքի կապակցությամբ առկա են եղել վարձակալական իրավահարաբերություններ, որոնց շրջանակներում
պարզապես վերակնքվել է վարձակալության պայմանագիրը՝ շարունակելով տարածքի օգտագործումը։


Ավելին, վերակնքված պայմանագրով ոչ միայն պահպանվել է ի սկզբանե նախատեսված վարձակալության ժամկետը (2026թ. փետրվարի 12), այլև ճշգրտվելու արդյունքում փոքրացվել է վարձակալության հանձնված տարածքը, բարձրացվել է վարձավճարը, հետևաբար գոյություն ունեցող վարձակալական իրավահարաբերությունները շարունակելու համար մրցույթ անցկացնելու անհրաժեշտությունը բացակայել է:


Հարկ է նաև նշել, որ 2001 թվականից սկսած՝ վարձակալված տարածքում առկա են սեփականության իրավունքով պատկանող շինություններ, որոնց նկատմամբ իրավունքները ձեռք են բերվել, և այսօր էլ առկա են բացառապես օրենքով սահմանված շրջանակներում և նախատեսված բոլոր շինարարական փաստաթղթերով:


Այսպիսով, ակնհայտ է, որ հասարակական նշանակության տարածքում իրականացվել են մեծ ներդրումներ՝ հաշվի առնլով երևանցիների հարմարավետությունը և ներդաշնակությունը հարևանությամբ գտնվող մշակութային հուշարձաններին ու կոթողներին: «Սանտաֆեն», ինչպես «Գալաքսի» ընկերությունների խմբի այլ նախագծեր, իրականացվել են Հայաստան բերելով զգալի ներդրումներ և նպաստելով երևանյան սրճարանային կոլորիտի ձևավորմանը։


Հավատարիմ լինելով հանրության հետ բաց հաղորդակցության քաղաքականությանը՝ «Գալաքսի» ընկերությունների խումբը մտահոգված է, որ առանց իրավական գործընթացների մասին պատշաճ ծանուցումներ ստանալու հանրությանն են ներկայացվում հայտարարություններ,
որոնք անհիմն կերպով վնասում են ընկերությունների գործարար համբավն ու հեղինակությունն՝ անհանգստացնելով «Գալաքսի» համայնքի աշխատակիցներին և մեր գործընկերներին։


Կրկին ընդգծում ենք, որ խնդրահարույց են վաղեմություն ունեցող իրադարձությունների առնչությամբ դատախազության կողմից իր հաղորդումների և դիրքորոշումների շտապողական և հրապարակային ծանուցումները, որոնք խաթարում են անմեղության կանխավարկածի էությունը։
