Սկանդալային ձևով պաշտոնից ազատվածը նոր պաշտոնի համար վարձահատույց է լինո՞ւմ. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ամիսներ առաջ Սյունիքի նախկին մարզպետ Սուրիկ Խաչատրյանի որդու՝ Տիգրան Խաչատրյանի նկատմամբ քրեական հետապնդում էր հարուցվել Քրեական օրենսգրքի 3 հոդվածներով՝ ապօրինի կերպով հրազեն կրելու, խուլիգանական դրդումներով առողջությանը թեթև վնաս պատճառելու և զենքի կամ մարմնական վնասվածք պատճառելու համար առարկայի կամ միջոցի գործադրմամբ կամ դրա գործադրման սպառնալիքով խուլիգանություն կատարելու համար։ Սա ի դեպ, առաջին դեպքը չէ, որ իշխանությունները թիրախավորում են Խաչատրյանի որդուն, դրանից առաջ էլ նրան ձերբակալել էին մայիսի 30-ին կառավարության 3-րդ շենքի մոտ տեղի ունեցած զանգվածային անկարգությունների համար, ըստ իրավաբանների՝ կրկին առանց որևէ լուրջ հիմնավորման, իսկ այնուհետև ստիպված էին ազատ արձակել: Խաչատրյանի փաստաբան Վահագն Քեշիշյանը ահազանգում է, որ իր պաշտպանյալի նկատմամբ վարույթը նախաձեռնվել է ոչ օբյեկտիվ և առանց բավարար փաստերի:

Նրա խոսքով, ըստ էության, վարույթի ընթացքը օբյեկտիվության հետ որևէ աղերս չունի, իսկ իրավապահ մարմինները պարզապես հլու-հնազանդ կերպով իրականացնում են քաղաքական իշխանություններից եկած պատվերը՝ աչք փակելով առկա փաստական տվյալների վրա: Սակայն, ուսումնասիրելով, թե ով է Տիգրան Խաչատրյանի գործով անչափ «սկզբունքային» քննիչը, ամեն բան, կարծես թե, ընկնում է իր տեղը: Բանն այն է, որ օրվա «հերոսը» ոչ այլ ոք է, քան Շիրակի նախկին դատախազ Գուրգեն Գրիգորյանը: Վերջինս իր հերթին հանդիսանում է Քննչական կոմիտեի ղեկավար Արգիշտի Քյարամյանի մտերիմը. Քյարամյանն ու Գրիգորյանը Շիրակի մարզի դատախազությունում միասին աշխատել են և, ըստ լուրերի, պահպանում են ջերմ հարաբերությունները։ Սակայն անգամ այդ ջերմ հարաբերությունները չօգնեցին Գրիգորյանին, երբ վերջինիս նախորդ տարի գլխավոր դատախազի հրամանով ազատեցին զբաղեցրած պաշտոնից: Նրա նկատմամբ քրեական վարույթ էր հարուցվել ԱԱԾ-ում՝ ՀՀ Քրեական օրենսգրքի 495 հոդվածի 3-րդ մասի 2-րդ կետով՝ գյումրեցի ընդդիմադիր իրավապաշտպան Կարապետ Պողոսյանի հայտարարության հիման վրա։

Ընդդիմադիր իրավապաշտպանը ԶԼՄ-ներով հայտարարել էր, որ դատախազը մի քանի շինծու քրեական գործեր է հարուցել իր նկատմամբ։ Ինքն էլ սոցիալական ցանցերում քննադատել է Գուրգեն Գրիգորյանին, որից հետո վերջինս քրեական ենթամշակույթ ունեցող անձանց է ուղարկել իր մոտ՝ գործարք առաջարկելով։ Ինչպես երևում է, նոր պաշտոնում էլ Գրիգորյանը չի դավաճանում իր ավանդույթներին՝ արդեն Սյունիքի մարզային քննչականի պետի պաշտոնում ամեն գնով փորձելով վարձահատույց լինել իրեն պաշտոնի նշանակած անձանց՝ այս անգամ էլ իշխանությունների աչքի փուշը դարձած Խաչատրյանների ընտանիքի հաշվին: Ըստ Խաչատրյանի փաստաբանի, գործով քննիչն իր ղեկավարի հանձնարարությամբ բացահայտ կերպով խոչընդոտում է քննության օրինական ընթացքին, և վերջինս ընթանում է ոչ թե օրենքի տառին ու ոգուն համապատասխան, այլ Գրիգորյանի քմահաճույքներով:
