«Փաստ» օրաթերթը գրում է

«Փաստ» օրաթերթի տեղեկություններով, 2023 թվականի հունիսի 7-ին Մարդու իրավունքների եվրոպական դատարանը որոշում է կայացրել «Մխիթարյանն ընդդեմ Հայաստանի» (գանգատ թիվ 8447/21), «Նախշքարյանն ընդդեմ Հայաստանի» (գանգատ թիվ 61807/21), «Մելքոնյանն ընդդեմ Հայաստանի» (գանգատ թիվ 6681/22), «Իսկանդարյանն ընդդեմ Հայաստանի» (գանգատ թիվ 27927/22), «Վարդազարյանն ընդդեմ Հայաստանի» (գանգատ թիվ 52297/22), «Փիլոսյանն ընդդեմ Հայաստանի» (գանգատ թիվ 19185/23), «Սուքոյանն ընդդեմ Հայաստանի» (գանգատ թիվ 19640/23) և «Անտոնյանն ընդդեմ Հայաստանի» (գանգատ թիվ 20140/23) գործերով կիրառել Եվրոպական դատարանի կանոնների 40-րդ և 41-րդ կանոնները՝ առաջնահերթություն տալով գանգատների քննությանը:

Վերը նշված գանգատները վերաբերում են Բարձրագույն դատական խորհրդի կողմից դիմումատուների նկատմամբ հարուցված կարգապահական վարույթներին և հետագայում՝ վերջիններիս լիազորությունների դադարեցմանը: Դա նշանակում է, որ մոտ ապագայում ՄԻԵԴ-ը կպատասխանի այն հարցին, թե արդյո՞ք 2020-2023 թվականների ընթացքում Բարձրագույն դատական խորհրդի կողմից Մարդու իրավունքների եվրոպական կոնվենցիային համապատասխան են պաշտոնից հեռացվել հիշատակված դատավորները:

Ըստ ոլորտի մասնագետների, այս հանգամանքը պետք է որ անհանգստացնի Բարձրագույն դատական խորհրդի անդամներին, ովքեր այս օրերին իրենց կողմից քննվող երկու վարույթներով (առաջինը վերաբերում է դատավոր Դ. Հարությունյանին, երկրորդը՝ դատավորներ Ա. Խառատյանին, Ա. Բարսեղյանին և Տ. Պետրոսյանին) Կարեն Անդրեասյանի գլխավորությամբ ամեն ինչ անում են դրանք ժամ առաջ ավարտելու և դատավորների լիազորությունները դադարեցնելու համար:
