Հանձնաժողովն անդարդ գլուխը ցավի տակ չի դնում. «Փաստ»

«Փաստ» օրաթերթը գրում է

Երկուշաբթի՝ հունիսի 19-ին Բարձրագույն դատական խորհրդի նիստում կքննվի սնանկության դատարանի դատավոր Սամվել Թադևոսյանին, վերաքննիչ քաղաքացիական դատարանի դատավոր Աստղիկ Խառատյանին, Վճռաբեկ դատարանի քաղաքացիական պալատի դատավորներ Արտակ Բարսեղյանին և Տիգրան Պետրոսյանին կարգապահական պատասխանատվության ենթարկելու հարցի վերաբերյալ ՀՀ արդարադատության նախարարի միջնորդությունը: Դատավորները «մեղադրվում են» նրանում, որ 2009 թվականին կայացված նրանց դատական ակտերը, Մարդու իրավունքների եվրոպական դատարանի 2019 թվականի վճռի համաձայն, հանգեցրել են Մարդու իրավունքների եվրոպական կոնվենցիայի 6-րդ հոդվածի 1-ին կետի խախտմանը։

Եվ ահա, այս վարույթի մասնակից դատավորներից մեկն օրերս դիմել էր Կոռուպցիայի կանխարգելման հանձնաժողով՝ բարձրացնելով երկու կարևոր հարց.

1) հանձնաժողովին առաջարկվել էր պարզել, թե ի՞նչ սկզբունքով է արդարադատության նախարարն ընտրում այն դատավորներին, որոնց նկատմամբ ՄԻԵԴ վճիռների հիմքով արդեն իսկ վարույթ է հարուցել կամ պատրաստվում է հարուցել, քանի որ կան խախտում թույլ տված մի քանի տասնյակ դատավորներ,

2) արդյո՞ք վարույթ հարուցող արդարադատության նախարար Գրիգոր Մինասյանի և գործը քննող ԲԴԽ-ի նախագահ Կարեն Անդրեասյանի ընկերական, գաղափարական և բիզնես կապերը կոռուպցիոն առումով ռիսկային չեն և չեն հանգեցնում շահերի բախման:

Հանձնաժողովը պատասխանել է, որ բարձրացված հարցերն իր իրավասության սահմաններից դուրս են, և մերժել է վարույթ հարուցելը, մինչդեռ վարույթ հարուցելու դեպքում բարձրացված առաջին հարցի կապակցությամբ հանձնաժողովը, համաձայն «Կոռուպցիայի կանխարգելման հանձնաժողովի մասին» օրենքի 31-րդ հոդվածի 4-րդ մասի, արդարադատության նախարարությունից կարող էր պահանջել և ստանալ հանձնաժողովում քննարկվող հարցին առնչվող ցանկացած նյութ, փաստաթուղթ կամ տեղեկություն և, ստանալով հարցի պատասխանը, քննել և լուծել շահերի բախման վերաբերյալ դիմումը, իսկ բարձրացված երկրորդ հարցի կապակցությամբ հանձնաժողովը ներկայացված և մամուլում առկա բազմաթիվ ապացույցների հիման վրա պարզապես պարտավոր էր փաստել, որ Մինասյանն ու Անդրեասյանը գործում են շահերի բախման իրավիճակում:

Սակայն, ի վերջո, հանձնաժողովում պաշտոնավարման ժամկետի ավարտի կապակցությամբ սույն տարվա նոյեմբերին իր առաքելությունն ավարտող Հայկուհի Հարությունյանը և նրա գործընկերները որոշեցին իրենց անդարդ գլուխը չդնել ցավի տակ՝ հնարավորություն տալով նույն գործով երկու մտերիմ ընկերներից մեկին լինել դատախազ, մյուսին՝ դատավոր, արդարադատության նախարարի համար էլ կանաչ լույս վառեցին՝ այսուհետ ևս օրենքն ընտրովի կիրառելու և իշխանությանն անհաճո դատավորներին պատժելու գործընթացը շարունակելու համար:
