«Գործ տվողներ» բուծելու օրինագիծը․ «Փաստ»

«Փաստ» օրաթերթը գրում է

Արդարադատության նախարարությունն օրենսդրական նախաձեռնություն է դրել շրջանառության մեջ, որով նախատեսվում է նաև ծանր և առանձնապես ծանր հանցագործություններ կատարած անձանց ազատել պատասխանատվությունից՝ գործուն զղջման հիմքով: Մասնագետներն արդեն իսկ անհեթեթություն ու խայտառակություն են որակել թե՛ նախագիծն ինքնին, թե՛ պատճառաբանությունը, այն է՝ իրավապահների ծանրաբեռնվածությունը նվազեցնելը, ինչպես նաև հսկայական ռիսկեր են տեսնում, այդ թվում՝ կոռուպցիոն։ Կա տեսակետ, թե սա կարող է վերաբերել, այսպես կոչված, «11 հազար դասալիքներին»:

Սակայն, շատերի կարծիքով, այս օրինագիծն իրականում ունի առաջին հերթին ստվերային, այն է՝ քաղաքական նպատակ: Բացի իշխանություններին ձեռնտու (քաղաքական, անձնական, ֆինանսական) անձանց նկատմամբ «ներողամտություն» ցուցաբերելու հանգամանքից, իրավաբաններն արդեն օրենքի նախագիծը որակում են նաև որպես «գործ տվողներ» բուծելու միջոց ու գործիք: Հարցն այն է, որ քաղաքական ենթատեքստ ունեցող բազմաթիվ «կարված» քրեական գործերով իրավապահները ջանք ու եռանդ չեն խնայում ընդդիմադիր գործիչների դեմ ցուցմունքներ կորզելու համար, այդ ճանապարհին առանձին անձանց նկատմամբ կիրառում են ազդեցության տարբեր միջոցներ, սակայն վերջիններս հրաժարվում են կեղծ ցուցմունք տալ՝ առաջին հերթին վախենալով, որ իրենք էլ կդատվեն նույն քրեական գործի շրջանակներում:

Հիմա, փաստորեն, իշխանությունները «գտել» են ձևը, և այս օրինագիծն ընդունվելու դեպքում կարող են ընդդիմադիրների դեմ ցուցմունք տվողներին ընտրողաբար ինդուլգենցիա տալ: Այսինքն, կձևավորեն, այսպես կոչված, «էլիտար գործ տվողների» համակարգ, իրենց ցանկալի ցուցմունքները կկորզեն, ցուցմունք տվողները «գործուն կզղջան», ըստ այդմ կստանան այդ ինդուլգենցիան ու մեղսակից չեն համարվի փաստորեն:
