Արդարադատության հուղարկավորության վերջին արարը. Վճռաբեկ դատարանի ամբողջական զավթման համար մնացել է քաղաքացիական պալատը

2018 թվականի «հեղափոխությունից» հետո քաղաքական իշխանությունը ձեռնամուխ եղավ դատական համակարգը ցանկացած գնով իրեն ենթարկեցնելուն: Դատարանները շրջափակելը, Սահմանադրական դատարանը Սահմանադրության և օրենքների կոպիտ ոտնահարմամբ զավթելը, քաղաքական իշխանության քիմքին ոչ հաճո դատական ակտ կայացնող դատավորների նկատմամբ հետապնդումները և նրանց լիազորությունների ապօրինի դադարեցումներն այդ ապօրինի գործունեության տարբեր արարներն էին:

Ըստ երևույթին, Գրիգոր Մինասյանի և Կարեն Անդրեասյանի ուսերին դրված է դատական իշխանությունը գրավելու առաքելությունը վերջնականապես ավարտին հասցնելու ծանր պարտականությունը: Սահմանադրական դատարանի զավթումից հետո քաղաքական իշխանությունը կենտրոնացել էր ընդհանուր իրավասության դատավորների վրա, սակայն քանի որ ընդհանուր իրավասության դատարանների դատավորների թիվը մոտ 300 է, բոլորին իրենցով անելը կամ յուրային դատավորներով փոխարինելը քաղաքական իշխանության համար չափից դուրս տևական գործընթաց կլիներ: Ուստի նրանք որոշեցին զավթել վճռաբեկ դատարանն՝ իր չորս պալատներով, որպեսզի անգամ եթե առաջին ատյանի և վերաքննիչ դատարաններում իրենց համար ոչ ցանկալի դատական ակտեր կայացվեն, վճռաբեկ դատարանում միշտ հնարավորություն լինի փոխել դրանք հօգուտ իրենց: Վճռաբեկ դատարանի չորս պալատներից երեքը՝ քրեական, վարչական և հակակոռուպցիոն պալատներն այսօր գերազանցապես համալրված են քաղաքական իշխանությանը սպասարկող դատավորներով:

Վճռաբեկ դատարանի ամբողջական զավթման համար մնացել է քաղաքացիական պալատը: Նախորդ շաբաթ գրվել էր ՄԻԵԴ վճռի հիմքով 4 դատավորների (որոնցից 2-ը՝ վճռաբեկ դատարանի քաղաքացիական պալատից) կարգապահական պատասխանատվության ենթարկելու մասին ՀՀ արդարադատության նախարար Գրիգոր Մինասյանի հարուցած կարգապահական վարույթի մասին: Եվ ահա, մեր տեղեկություններով, այդ 4 դատավորներից 2-ը բացատրություն են ներկայացրել ԲԴԽ-ին, որտեղ պատշաճ կերպով մատնացույց են արել վարույթի բոլոր աղաղակող խախտումները: ԲԴԽ նիստը դեռևս նշանակված չէ, սակայն ակնհայտ է, որ իշխանությունները հերթական անգամ կանգնած են իրավական խայտառակության շեմին:

Մեր տեղեկություններով, անկախ ամեն ինչից, քաղաքական իշխանությունը հստակ նպատակ է դրել այս գործով դադարեցնել դատավորների լիազորությունները. նրան չեն հետաքրքրում ոչ իր նպատակներին հասնելու եղանակների անօրինականությունը, ոչ միջազգային մարմինների զեկույցները ՀՀ-ում արդարադատության վիճակի մասին, այդ թվում՝ «Հայաստանի Հանրապետությունում դատական իշխանության անկախության վրա ազդեցություն ունեցող մարտահրավերների (խնդիրների) վերաբերյալ» Դատավորների եվրոպական միության 2023 թվականի հունիսի 2-ի բանաձևը, որում խոսվում է դատավորների նկատմամբ չարաշահումներով կարգապահական վարույթների հարուցումից:
