Ալավերդու մանկապարտեզի դաստիարակչուհու անզգուշության պատճառով 3-ամյա երեխան խեղդվել է Դեբեդ գետում

Լոռու մարզի ընդհանուր իրավասության դատարանում Սուրեն Բաղդասարյանի նախագահությամբ ավարտվել է Ալավերդու մանկապարտեզի դաստիարակչուհի Գայանե Մալխասյանի գործի դատական քննությունը։

Ըստ մեղադրանքի՝ 49-ամյա Գայանե Մալխասյանը, աշխատելով Ալավերդու թիվ 3 մանկապարտեզում՝ որպես դաստիարակ, «պարտավոր լինելով պահպանել երեխաների կյանքը, ի պաշտոնե՝ հաստատությունում եղած ժամանակ երեխաների կյանքի ու առողջության համար կրելով անձնական պատասխանատվություն, պարտավոր լինելով իրականացել հոգածություն և մանրազնին հսկողություն իրեն վստահված երեխաների նկատմամբ, ցուցաբերել է հանցավոր անգործություն և անփութություն»։

2017 թվականի փետրվարի 14-ին, ժամը 9-ն անց 30-ի սահմաններում Գայանեն մանկապարտեզի տնօրենի հանձնարարությամբ կամավոր ստանձնել է նախադպրոցական ուսումնական հաստատությունում գտնվելու ընթացքում մանկահասակ՝ 2013 թվականի ապրիլի 6-ին ծնված Ռոբերտ Դ.-ի նկատմամբ հոգածություն և հսկողություն իրականացնելու պարտականությունը։ Սակայն դաստիարակչուհին, դրսևորելով «անկարգապահություն և անշրջահայացություն»՝ անուշադրության է մատնել երեխային, ինչի արդյունքում երեքամյա երեխան դուրս է եկել մանկապարտեզի շենքից, ապա դուրս է եկել նաև մանկապարտեզի տարածքից, գնացել է մանկապարտեզից շուրջ 300 մետր հեռավորությամբ հոսող Դեբեդ գետի ափը և բերանքսիվայր ընկել է գետը։ Երեխայի դին հայտնաբերվել է Դեբեդի ափին նույն օրը՝ ժամը 10-ն անց 30-ի սահմաններում։

Ըստ փորձագիտական եզրակացության՝ երեխայի մահվան պատճառ է եղել շնչուղիները հեղուկով՝ ջրով փակվելու հետևանքով առաջացած մեխանիկական շնչահեղձությունը։

Ըստ մեղադրանքի՝ մանկապարտեզի դաստիարակը անզգուշությամբ երեխայի մահն է առաջացրել։ Գայանե Մալխասյանին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 109 հոդվածի 1-ին մասով։ Նրա խափանման միջոցն էր ստորագրությունը հեռանալու մասին։

Դատարանում ամբաստանյալն իրեն լիովին մեղավոր է ճանաչել, զղջացել է, նրա միջնորդությամբ գործը քննվել է արագացված ընթացակարգով։

Մեղսագրված արարքի համար օրենքով նախատեսված առավելագույն պատիժը մինչև 3 տարի ազատազրկումն է։

Դատարանը հաշվի է առել, որ Գայանե Մալխասյանը բնութագրվում է դրական, իրեն մեղավոր է ճանաչել, զղջացել է, տուժողը նրա նկատմամբ բողոք կամ պահանջ առաջ չի քաշել։

Դատարանը հաշվի է առել նաև կատարված արարքի հանրային վտանգավորության աստիճանը։

Գայանե Մալխասյանը դատապարտվել է 3 ամիս ազատազրկման։ Այս պատիժը նա պայմանականորեն չի կրի, նրա նկատմամբ սահմանվել է 1 տարի փորձաշրջան։
