«Ապրելու երկիր» կուսակցությունը նամակ է ուղարկել Հայաստանում Ամերիկայի Միացյալ Նահանգների դեսպանին

«Ապրելու երկիր» կուսակցությունը նամակ է ուղարկել Հայաստանում Ամերիկայի Միացյալ Նահանգների դեսպանին՝ խնդրելով, որ ԱՄՆ զերծ մնան 1992 թվականին Սենատի կողմից ընդունված Ազատության աջակցման ակտի 907-րդ մասը դադարեցնելուն ուղղված գործողություններից, որով սահմանված են պատժամիջոցներ Ադրբեջանի նկատմամբ։

«Ինչպես տեղյակ եք, Ադրբեջանն արդեն չորս օր է` արգելափակման մեջ է պահում Լեռնային Ղարաբաղի (Արցախ) ժողովրդին։ 2022թ․ դեկտեմբերի 12-ին Ադրբեջանը դարձյալ փակեց Արցախը Հայաստանի Հանրապետության հետ կապող միակ ճանապարհը՝ Լաչինի (Քաշաթաղ) միջանցքը։ 

Ադրբեջանի կողմից ՄԱԿ-ի կանոնադրության 4(2) հոդվածի կոպիտ խախտմամբ սանձազերծված և հազարավոր զոհերի և վիրավորների և քաղաքացիական ենթակառուցվածքների ոչնչացման պատճառ ագրեսիայից հետո դեռ չվերականգնված Արցախն իր ավելի քան 120 000 բնակչությամբ դարձյալ թիրախում հայտնվեց։ 
Տասնյակ հազարավոր երեխաներ, կանայք և տարեցներ կանգնած են մարդասիրական աղետի առջև։ 

Ադրբեջանը չի թաքցնում, անգամ պաշտոնական մակարդակով բազմիցս հայտարարում է, որ այս ամենի վերջնական նպատակը Արցախի հայերի էթնիկ զտումը կամ բնաջնջումն է, ինչը ըստ Ցեղասպանության հանցագործությունը կանխելու և պատժելու մասին 1948թ․ կոնվենցիայի 2-րդ հոդվածով սահմանված կարգի ցեղասպանական հանցագործության դրսևորումներից մեկն է՝ այս կերպ հայերի համար միտումնավոր ստեղծելով կյանքի այնպիսի պայմաններ, որոնք ուղղված են նրանց լրիվ կամ մասնակի ֆիզիկական ոչնչացմանը։ 

Հայատյացության այս քաղաքականության մասին ամենաբարձր պաշտոնական մակարդակով բարձրաձայնել է նաև Արդարադատության միջազգային դատարանը 2021թ-ի դեկտեմբերի 7-ին Հայաստանն ընդդեմ Ադրբեջանի գործով տրված միջանկյալ որոշման մեջ (https://www.icj-cij.org/.../180-20211207-PRE-01-00-EN.pdf)՝ պարտադրելով ձեռնարկել բոլոր անհրաժեշտ միջոցները, այդ թվում, ադրբեջանցի պաշտոնյաների և հասարակական հաստատությունների կողմից հայ ազգության կամ էթնիկական ծագման անձանց նկատմամբ ռասսայական ատելության և խտրականության հրահրումը և խթանումը կանխելու համար: 


Նկատի ունենալով Ամերիկայի Միացյալ Նահանգների ժողովրդի և կառավարության ամուր հանձնառությունը Մարդասիրությանը, Արդարադատությանը և Միջազգային իրավունքի սկզբունքներին, 

Վերհիշելով ԱՄՆ Կոնգրեսի կողմից 1992թ․ ընդունված Ազատության աջակցության ակտը (Հանրային իրավունք No: 102-511) - https://www.congress.gov/.../102.../senate-bill/2532/text... 


Եւ ուշադրության արժանացնելով այն, որ Հայաստանի նկատմամբ Ադրբեջանի թշնամական գործողությունների առնչությամբ նրանով նախատեսված միակ կանոնը, որի համաձայն․ «Միացյալ Նահանգները սույն կամ ցանկացած այլ ակտով չի կարող Ադրբեջանի կառավարությանը օժանդակություն տրամադրել, քանի դեռ նախագահի կողմից չկա որոշում և Կոնգրեսին ներկայացված զեկույցում առ այն, որ Ադրբեջանի կառավարությունը ակներև քայլեր է ձեռնարկում Հայաստանի և Լեռնային Ղարաբաղի նկատմամբ բոլոր շրջափակումները և հարձակողական ուժի կիրառման այլ դրսևորումները դադարեցնելու ուղղությամբ» (ՄԱՍ.907), 

Խնդրում ենք Ձեզ ԱՄՆ օրենքներով և միջազգային իրավունքով սահմանված կարգով շարունակել վերը նշված ակտի իրագործումը և զերծ մնալ Ազատության աջակցման ակտի 907-րդ մասը դադարեցնելուն ուղղված գործողություններից»։
