Արցախը չի՛ եղել, չի՛ կարող և չի՛ լինելու Ադրբեջանի կազմում. «Ապրելու երկիր» կուսակցություն

«Ապրելու երկիր» կուսակցությունը հայտարարություն է տարածել Ռուսաստանի
Դաշնության արտաքին գործերի նախարար Սերգեյ Լավրովի՝ նախօրեին Արցախի
կարգավիճակի վերաբերյալ արած հայտարարության վերաբերյալ։

«Ապրելու երկիր» կուսակցությունը տարածաշրջանում կայուն ու երկարատև խաղաղության հաստատման գերակայությունը միանշանակ ընդունելով հանդերձ, հայտնում է, որ Ռուսաստանի Դաշնության ԱԳ նախարարի հայտարարությունը պարունակում է որոշակի անհստակություններ՝ կապված Հայաստանի՝ Ալմա-Աթայի հռչակագիրն առանց նախապայմանների ստորագրելու հետ։

Մասնավորապես, հայտարարության մեջ նշված Ալմա-Աթայի Հռչակագրի հիմք հանդիսացող Անկախ պետությունների համագործակցության ստեղծման մասին համաձայնագիրը Հայաստանի Հանրապետության Գերագույն Խորհուրդը 1992թ․ փետրվարին վավերացրել է վերապահումներով։ Հայաստանի համար գործում է Համաձայնագրի 5-րդ հոդվածը՝ հետևյալ կարևոր բովանդակությամբ՝ «Կողմերը ճանաչում և հարգում են ազգերի ազատ ինքնորոշման իրավունքը, միմյանց տարածքային ամբողջականությունը և սահմանների անձեռնմխելիությունը»։

Ավելին, Հռչակագրում օգտագործված բառապաշարը՝ «ճանաչելով և հարգելով միմյանց տարածքային ամբողջականությունն ու գոյություն ունեցող սահմանների անխախտելիությունը» վերաբերել է գոյություն ունեցող սահմաններին, որոնք Ադրբեջանի մասով հարաբերական են եղել հենց Արցախի Հանրապետության գոյության փաստի ուժով, ինչը նշանակում է, որ հստակ սահմանազատում չի եղել Հայաստանի և Ադրբեջանի միջև։ Իսկ ԽՍՀՄ վարչատարածքային բաժանումը չէր կարող uti possidetis juris սկզբունքի տրամաբանությամբ դառնար պետական սահման, որովհետև նախ այդ սկզբունքը մեխանիկորեն գործող սկզբունք չէր և կիրառվել է միայն Հարավային Ամերիկային և Աֆրիկայի որոշ ապագաղութացվող պետությունների միջև հստակ համաձայնության առկայության ու շատ խիստ պայմանականություններով, իսկ այնուհետև՝ Հայաստանը և Ադրբեջանը՝ որպես անկախ պետություններ, մինչև նշված Հռչակագրի վավերացումը, երբևէ սահմանազատում և սահմանագծում չեն արել, որպեսզի գոյություն ունենար Հռչակագրում նշված սահմանը։

Միևնույն ժամանակ, Մինսկի խմբի շրջանակներում ընթացած բանակցությունները, որոնք տևել են երկուսուկես տասնամյակ, ուղղված են եղել համաձայնության գտնելուն հենց Արցախի կարգավիճակի հարցում, այլ ոչ թե Ալմա-Աթայի Հռչակագրի՝ պարոն Լավրովի մեկնաբանության հաստատմանը։
