Անահիտ Ավանեսյանի հերթական սկանդալային նախագիծը. ի՞նչ կանի ՄԻՊ-ը

Հայաստանի առողջապահության նախարարությունը հուլիսի 15-ին նոր օրենսդրական նախագիծ է ներկայացրել՝ առաջարկելով փոխել «կամավոր ամլացման» օրենսդրական կարգավորումները, միաժամանակ առաջարկելով անգործունակ ճանաչված մարդկանց ամլացում՝ դատարանի որոշմամբ։ Հանրային քննարկման ներկայացված նախագիծը, ի թիվս այլնի, սահմանում է «դատարանի կողմից անգործունակ կամ սահմանափակ գործունակ ճանաչված անձանց` բժշկական ցուցումներով ամլացումը` դատարանի որոշմամբ»։  Այս ձևակերպումը կարող է նշանակել, որ թույլատրվում է որոշում կայացել առանց անձի համաձայնության։ Մարդու իրավունքների պաշտպանությամբ զբաղվողների տեսակետի համաձայն` այս դրույթը «խախտում է նախագծի՝ կամավորության սկզբունքի վրա հիմնված լինելը» և այն դարձնում «հարկադիր ամլացման» նախագիծ։ 

Սա Անահիտ Ավանեսյանի առաջին հակասահմանադրական քայլը չէ, ավելին` սա ՀՀ Սահմանադրության մի շարք հոդվածներ խախտելուց բացի խախտում է նաև միջազգային կոնվենցիաներ, որոնց ժամանակին միացել է Հայաստանը: Հետաքրքիր է` դեռ որքա՞ն է նախարարը շարունակելու իր այս գործելաոճը` աչք փակելով մայր օրենքի և մարդկանց իրավունքների վրա՝ մնալով անպատիժ:

Այս համատեքստում ուշագրավ է, թե ինչ քայլերի կդիմի ՄԻՊ-ը: Արդյո՞ք Քրիստինե Գրիգորյանն Անահիտ Ավանեսյանի առաջ քաշած նախագծում չի տեսնում մարդկանց իրավունքների կոպիտ ոտնահարման բացահայտ տարրեր և չի պատրաստվում նույնքան օպերատիվ կերպով դիմել ՍԴ, ինչպես դա արեց աղանդավորների իրավունքները պաշտպանելու համար: Եթե ոչ, ապա արդեն իսկ պարզ է դառնում, թե ում շահերն ու իրավունքներն է պաշտպանում նորաթուխ ՄԻՊ-ը...
