Դատախազությունը դեմ չէ, որ Ավետիք Չալաբյանն ազատ արձակվի, Փաշինյանը դեմ է

Հայաստանի վերաքննիչ քրեական դատարանը օգոստոսի 30-ին կհրապարակի «ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի գործով կալանքի տակ պահելու դեմ փաստաբանների ներկայացրած բողոքի վերաբերյալ իր որոշումը։

Օգոստոսի 26-ին կայացած նիստում նույնիսկ մեղադրող կողմն է նշել, որ կալանքից բացի, խափանման միջոցները՝ գրավը կամ անձնական երաշխավորությունները, կարող են ապահովել Չալաբյանի պատշաճ վարքագիծը։ Ինքը՝ Չալաբյանն էլ, արձանագրել էր, որ իրեն կալանքի տակ են պահում բացառապես մեկ մարդու քաղաքական որոշմամբ։

«Նիկոլ Փաշինյանից ի՞նչ հրահանգ ունեն, նախ պետք է դա, իհարկե, Նիկոլ Փաշինյանին հարցնել, թե երկրի վարչապետի պաշտոնում նստած մարդն ինչո՞ւ է ընկել կոնկրետ առանձին վերցրած քաղաքացու հետևից»,- հարցադրում էր արել Ավետիք Չալաբյանը և նշել, որ դա ունի առնվազն մի քանի պատճառ։

 «Մի պատճառն իմ գործունեությունն է Արցախի ու մեր անվտանգային համակարգի հետ կապված, քանի որ այս իշխանությունը հակված է համատարած կապիտուլյացիայի բոլոր հարցերում, ցանկացած մարդ, ով իրենց խանգարում է, պետք է գտնվի կալանավայրում այդ ընթացքում»,- ասել էր Ավետիք Չալաբյանը։

Չալաբյանն այսօր կալանքի տակ է ընդամենը մեկ մարդու՝ տխրահռչակ դատավոր Մնացական Մարտիրոսյանի որոշմամբ և Նիկոլ Փաշինյանի հրահանգով, նույնիսկ դատախազությունը, որը շատ դեպքերում կատարում է Փաշինյանի կամքը, դեմ չէ, որ Ավետիք Չալաբյանը գտնվի ազատության մեջ, նրա խափանման միջոցը փոխվի՝ կարծելով, որ նա որևէ կերպ չի կարող ազդել քննության ընթացքին, կամ ճնշումներ բանեցնել վկաների վրա, առավել ևս, որ գործող միակ ցուցմունք տվողը Ագրարային համալսարանի ուսանողական խորհրդի նախագահ Թոռնիկ Ալիյանը, նոր պաշտոն է ստացել Ագրարային համալսարանից՝ պարգևատրվելով հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի դեմ կեղծ ցուցմունք տալու համար։

Մեկ օր անց պարզ կլինի արդյո՞ք Ավետիք Չալաբյանը կհայտնվի ազատության մեջ, թե՞ վերաքննիչ քրեական դատարանի դատավոր Ռուզաննա Բարսեղյանն էլ է կատարում Նիկոլ Փաշինյանի կամքը։

Որևէ զարգացում հնարավոր չէ բացառել, հատկապես, որ ստեղծված իրավիճակում որոշ դատավորներ կարողանում են ինքնուրույն վճիռներ կայացնել։ Եվ այդ համակարգում ոչ բոլորն են Մնացական Մարտիրոսյան։
