Վերաքննիչը բացառության կարգով կքննի Ավետիք Չալաբյանի բողոքը

Վերաքննիչ քրեական դատարանն այսօր կքննի «ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի խափանման միջոցի բողոքարկումը։

Ավետիք Չալաբյանի պաշտպանական խումբը տեղեկացնում է, թե նախագահող դատավորն է Ռուզաննա Բարսեղյանը, իսկ ապօրինի կալանավորման դեմ բերված վերաքննիչ բողոքը կքննի ընդհանուր կարգից բացառություն սահմանող ընթացակարգով, այն է` բանավոր։ Դատական նիստը լինելու է դռնբաց:

Հիշեցնենք, որ Ավետիք Չալաբյանը կալանավորվել էր մայիսի 14-ին հանցակազմի բացակայությամբ շինծու քրեական գործով, ապա հուլիսի 27-ին ազատ էր արձակվել` դատարանի կողմից սահմանված կալանքի ժամկետը լրանալու արդյունքում և նորից կալանավորվել մեկ շաբաթ անց:

Ըստ փաստաբանների՝ քրեական գործի հարուցման հիմք է հանդիսացել նախաքննության ընթացքում այդպես էլ չպարզված, անհայտ աղբյուրից ստացված ապօրինի մի ձայնագրություն, որը հանդիսանում է օրենքի խախտմամբ ձեռք բերված ապացույց և չի կարող դրվել Ավետիք Չալաբյանի մեղադրանքի հիմքում:

Ավելի վաղ Չալաբյանը հայտարարել էր, որ իր կալանավորման որոշումն աննախադեպ է Հայաստանի իրավական պրակտիկայում․ թերևս հազվագյուտ դեպք է, երբ անձը կալանավորվում է հիմքերի լիակատար բացակայության և օրենքի միարժեք պահանջների կոպիտ խախտման պայմաններում:

Չալաբյանի ազատ արձակման համար երաշխավորագրեր էին ներկայացրել մեկ տասնյակից ավելի հարգված գործիչներ, բայց գործող իշխանություններն ամեն ինչ անում են նրան կալանքի տակ պահելու համար։ Թեև առանձնակի հույսեր չկան, որ վերաքննիչ դատարանում հրաշք տեղի կունենա, և կհաղթի արդարադատությունը, սակայն դատավորը ստիպված կլինի դռնբաց նիստում, ի տես հանրության քննություն իրականացնել։

Եթե տխրահռչակ Մնացական Մարտիրոսյանի համար առանձնակի տարբերություն չկա, թե իր բարոյական կերպի մասին ինչ են մտածում, ապա վերաքննիչի դատավորները բարոյական լուրջ ճնշման տակ են լինելու։
