Ոչ սթափ վիճակում գտնվող վարորդը հարվածել է ոստիկանին՝ պատճառելով մարմնական վնասվածք․ ՔԿ

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Արաբկիր վարչական շրջանի քննչական բաժնում ձեռնարկվում են անհրաժեշտ միջոցառումներ՝ պաշտոնատար անձի օրինական ծառայողական գործունեությանը միջամտելու, ոստիկանի նկատմամբ բռնություն գործադրելու բոլոր հանգամանքները պարզելու ուղղությամբ:

Նշենք, որ դեպքի վերաբերյալ ՀՀ ոստիկանության պարեկային ծառայության աշխատակցի կողմից համապատասխան զեկուցագիրը ներկայացվել է 2022թ. հուլիսի 21-ին, համաձայն որի՝ ՀՀ ոստիկանության պարեկային ծառայության աշխատակիցները նշված օրը ծառայություն իրականացնելիս Հ.Հակոբյան փողոցում՝ ժամը 17:30-ի սահմաններում, նկատել են, որ «ԲՄՎ» մակնիշի ավտոմեքենան, խախտելով Ճանապարհային երթևեկության կանոնները, ստեղծել է վթարային իրավիճակ:

Պարեկները, օրենքով սահմանված կարգով հիշյալ ավտոմեքենան կանգնեցնելուց հետո, վարորդից պահանջել են ներկայացնել փաստաթղթերը և ստուգել վերջինիս սթափության աստիճանը, ինչի արդյունքում պարզվել է, որ նա գտնվում է ոչ սթափ վիճակում: Ոստիկանության ծառայողները վարորդին տեղեկացրել են, որ ոչ սթափ վիճակում ավտոմեքենա վարելու համար պատրաստվում են համապատասխան ակտ կազմել:

Սակայն վարորդը, դրսևորելով ագրեսիվ վարքագիծ, սկսել է հայհոյել ոստիկաններին, սպառնալ, որի ընթացքում գլխով հարվածել է ոստիկաններից մեկին՝ պատճառելով մարմնական վնասվածք, իսկ ոստիկանության Արաբկիրի բաժին բերելու ճանապարհին ոտքով հարվածել ու վնասել է պարեկային ավտոմեքենան:

Իրականացված միջոցառումների արդյունքում պարզվել է վարորդի ինքնությունը և նա, հանցանք կատարելու մեջ անմիջականորեն ծագած կասկածանքով, ձերբակալվել և ներկայացվել է ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Արաբկիր վարչական շրջանի քննչական բաժին, որտեղ ՀՀ քրեական օրենսգրքի 452-րդ հոդվածի 3-րդ մասով նախատեսված հանրորեն վտանգավոր արարքի հատկանիշներով նախաձեռնվել է քրեական վարույթ: Վնասվածք ստացած ոստիկանը ճանաչվել է տուժող և հարցաքննվել:

Վարորդը ձերբակալվել է: Միջնորդություն է ներկայացվել դատախազին՝ վերջինիս նկատմամբ քրեական հետապնդում հարուցելու մասին:

Կատարվել են մի շարք վարութային և քննչական գործողություններ, այդ թվում՝ հարցաքննություններ, զննության է ենթարկվել պարեկային ավտոմեքենան, նշանակվել են դատաբժշկական, դատահետքաբանական և դատաապրանքագիտական փորձաքննություններ:

Նախաքննությունը շարունակվում է: 

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ,քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
