Չալաբյանի պատմությունն արդեն անցել է իրավական լկտիության բոլոր սահմանները

«ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի փաստաբանները վաղուց այլևս հույսը կտրել են Հայաստանի արդարադատության համակարգից և բոլոր ԶԼՄ-ների, իրավապաշտպան կազմակերպությունների, միջազգային կառույցների և անձանց ուշադրությունը հրավիրում են աղաղակող ամենաթողության և անօրինականության փաստի վրա, որ տեղի է ունենում Չալաբյանի հետ։

Ըստ փաստաբանների՝ Չալաբյանի գործով քննիչն ու դատախազը կոպտորեն խախտում են քրեական դատավարության օրենսգրքով սահմանված ընթացակարգը՝ նրան ապօրինաբար անազատության մեջ պահելու համար։

Հիշեցնենք՝ նախօրեին դատավոր Արուսյակ Ալեքսանյանը մասնակի բավարարեց քննիչի միջնորդությունը և 15 օրով երկարաձգեց Չալաբյանի կալանքը։ Ըստ փաստաբանների՝ դա արվել էր զուտ այն բանի համար, որպեսզի քննիչն ու դատախազը հասցնեն գործն ուղարկել դատարան Չալաբյանի կալանքի պայմաններում։ Հակառակ դեպքում, եթե Ավետիք Չալաբյանը հունիսի 12-ին հայտնվեր ազատության մեջ, ապա գործը դատարան ուղարկելու դեպքում դատավորը կալանքի հարց չէր քննարկելու։

Նախօրեին կայացած նիստում ելույթ է ունեցել նաև Ավետիք Չալաբյանը, փաստերով ապացուցել, որ ինքը չի կարող խոչընդոտել վարույթին։

«Ես ինչպե՞ս կարող եմ վարույթին խոչընդոտել, եթե վարույթն ավարտել եք, ի՞նչ կարող եմ ես անել, եթե դուք վարույթն ավարտել եք, ուրեմն դատախազի կողմից առաջարկված գործողությունները փաստացի ավարտել եք, արդեն չկա որևէ տրամաբանական գործողություն, որին ես կարող եմ խոչընդոտել»,- նշել է Ավետիք Չալաբյանը։

Իսկ նախաքննական մարմնի դիտարկմանը, թե կալանքից ազատվելու դեպքում նա փախուստի կդիմի, հասարակական-քաղաքական գործիչը պատասխանել է տրամաբանված և լիովին փաստարկված։

«Ի՞նչ է նշանակում փախուստ մի մարդու համար, որը 5 ընկերությունների տնօրենների խորհրդի անդամ է, 2 բարեգործական հիմնադրամների հոգաբարձուների խորհրդի անդամ է, մեծ ընտանիքի հայր, 4 երեխաների հիմնական կերակրող, 2 տարեց ծնողների խնամակալ: Գրել եք այս ամենը՝ ընդամենը գրելու համա՞ր: Ո՞նց ես կարող եմ փախուստի դիմել: Մի մարդ, ով Հայաստան է վերադարձել պատերազմի օրերին՝ 3 տղա երեխաներով։ Մեր երկրի բնակչության զգալի մասն իր երեխաներին փախցնում է, 3 տղա երեխաներով Հայաստան եմ վերադարձել, որ փախչե՞մ Հայաստանից»,- ասել է Ավետիք Չալաբյանը, իսկ նախաքննական մարմինը բացարձակ որևէ փաստարկ չի ունեցել հակադարձելու նրան։

Ինչևէ դատարանը որոշում է կայացրել երկարաձգել Չալաբյանի կալանքի ժամկետը։ Գործ ունենք մի իրավիճակի հետ, երբ անգամ իշխանությանը մոտ կանգնած իրավապաշտպանները և քաղաքագետները արձանագրում են, որ ստեղծված իրավիճակը բացարձակապես առնչություն չունի արդարադատության հետ։

Քաղաքագետ Բորիս Նավասարդյանը երեկ ֆեյսբուքյան գրառում է արել՝ արձանագրելով, որ Ավետիք Չալաբյանի պատմությունն արդեն անցել է իրավական լկտիության բոլոր սահմանները։ Ըստ էության, սա ևս մեկ անգամ վկայում է, որ գործ ունենք դասական, լկտի քաղաքական հետապնդման հետ։
