Հերթական ապօրինությունն է գրանցվել Ավետիք Չալաբյանի գործի քննության հարցում. պաշտպանական խումբ

Մայիսի 14-ին կալանավորված հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի փաստաբան Վարազդատ Հարությունյանը այսօր հանրային հրապարակում է կատարել, որտեղ իրավապաշտպան կազմակերպությունների ուշադրությունն է հրավիրել Չալաբյանի գործով իրականացվող հերթական իրավախախտման վրա: Վարազդատ Հարությունյանը, մասնավորապես, տեղեկացրել է, որ Ավետիք Չալաբյանի խափանման միջոցն այլ խափանման միջոցով փոխելու միջնորդության մերժման որոշման դեմ փաստաբանների կողմից բերված վերաքննիչ բողոքը ավտոմատ համակարգով մակագրվել է մի դատավորի, ապա, ըստ երևույթին արդեն ոչ ավտոմատ համակարգով նշանակվել այլ դատավորի, ինչը դատարանի վրա ներգործության արձանագրում է և ակնհայտ ապօրինություն: 

"Երեկ զանգում ենք Վերաքննիչ  քրեական դատարանի գրասենյակ և շատ հստակ պատասխանում են, որ դատավոր Արշակ Վարդանյանին են մակագրել գործի քննությունը։ Այսօր զանգահարում ենք պարոն Վարդանյանի կազմ՝ տեղեկանալու, թե արդյոք նիստ նշանակվել է։ Պատասխանում են, որ մենք այդպիսի գործ չենք ստացել։ Կրկին զանգահարում ենք գրասենյակ և մեզ պատասխանում են, որ գործը մակագրվել է դատավոր Տիգրան Սիմոնյանին",- իր ֆեյսբուքյան գրառման մեջ պատմել է Վարազդատ Հարությունյանը: Նա ընդգծել է, որ սա հերթական ապօրինությունն է, որին իրենք դեռ կանդրադառնան: 

Հատկանշական է, որ Ավետիք Չալաբյանի գործը վերամակագրվել է այս պահին դատավորների վարկանիշավորման "helpcourt" համակարգում ամենացածր ռեյթինգ ունեցող դատավորին: Հետաքրքիր զուգադիպությամբ վատագույն ռեյթինգի երկրորդ հորիզոնականում այն դատավորն էր, որի կայացրած կալանավորման որոշումը դեմ հենց փաստաբանների բողոքն էր քննվելու: Նշենք, որ դատավորների ռեյթինգը ձևավորվում է բացառապես իրավական գնահատականների վրա և վատագույն ռեյթինգը կարող է նշանակել ենթադրյալ կանխակալություն և ոչ արդար որոշումներ: 

«Համախմբում» շարժման անդամ, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանին անհիմն, առանց որևէ արժանահավատ ապացույցի և քրեադատավարական ընթացակարգերի կոպտագույն խախտումներով մեղսագրվում է ՀՀ քրեական օրենսգրքի 163-րդ հոդվածի 3-րդ մասի 2-րդ կետով նախատեսված արարքը, որն արդեն ընդունված և սույն թվականի հուլիսի 1-ից ուժի մեջ մտնող քրեական օրենսգրքով փոփոխությունների է ենթարկվել:
