Գագիկ Ջհանգիրյանն իր հայտարարությամբ կասկածի տակ է դնում Ավետիք Չալաբյանի նկատմամբ իրականացվող քրեական հետապնդման օրինականությունը

Բարձրագույն դատական խորհրդի նախագահի ժամանակավոր պաշտոնակատար Գագիկ Ջհանգիրյանը, 23.06.2022թ․ Հանրային հեռուստատեսության եթերում պատասխանելով լրագրող Պետրոս Ղազարյանի հարցին, անդրադարձավ Ավետիք Չալաբյանին գաղտնալսելու հանգամանքին՝ նշելով, որ ենթադրում է, թե դա եղել է դատարանի որոշման հիման վրա։ Գագիկ Ջհանգիրյանի «ենթադրությունների» վերաբերյալ հայտնում ենք հետևյալը. Նախ` «Օպերատիվ-հետախուզական գործունեության մասին» ՀՀ օրենքի 31-րդ հոդվածի 4-րդ մասի համաձայն` գաղտնալսումը որպես օպերատիվ-հետախուզական միջոցառում կարող էր իրականացվել բացառապես այն դեպքում, երբ Ավետիք Չալաբյանը կասկածվեր ծանր կամ առանձնապես ծանր հանցագործություն կատարելու մեջ, իսկ Ավետիք Չալաբյանին մեղսագրվել է միջին ծանրության հանցագործություն։ Երկրորդ` անհասկանալի է, թե արդյոք պարոն Ջհանգիրյանի ենթադրությունը ներառում է նաև, որ, օրինակ, դատարանը թույլատրել է ոչ միայն գաղտնալսել Չալաբյանին և մյուս զրուցակիցներին, այլ նաև՝ գաղտնալսման ձայնագրությունը մոնտաժելն ու ինչ-որ լրատվական միջոցի տրամադրելը։ 

Հիշեցնենք, որ քննարկվող ձայնագրությունը, որն ակնհայտորեն մոնտաժված է, տեղադրվել էր medianews.am լրատվական կայքում։ Երրորդ` գործում առկա են բազմաթիվ փաստեր, որոնք թույլ են տալիս լիարժեքորեն ժխտել գաղտնալսումը դատարանի որոշման հիման վրա իրականացված լինելու ենթադրությունը, սակայն նախաքննական գաղտնիքի շրջանակներից դուրս չգալու պահանջը չխախտելու նպատակով այս փուլում այդ հանգամանքներին չենք անդրադառնա։ 

Այդուհանդերձ, իհարկե, չենք բացառում, որ քննարկվող գաղտնալսումն ու ձայնագրությունն իրականացվել է իրավապահ մարմինների կողմից, սակայն միանշանակ բացառում ենք, որ այդ գաղտնալսումն ու ձայնագրությունն իրականացվել է օրինական ճանապարհով։ Միաժամանակ հայտարարում ենք, որ մեր գնահատմամբ պարոն Ջհանգիրյանը խախտել է «ՀՀ դատական օրենսգիրք» սահմանադրական օրենքով սահմանված դատավորին ներկայացվող վարքագծի կանոն՝ այն է, հրապարակայնորեն կարծիք է հայտնել մի գործով, որով ինքը հանդես չի գալիս ո՛չ որպես կողմ, ո՛չ էլ` կողմի ներկայացուցիչ։ Ըստ այդմ՝ իր հայտարարությամբ ևս մեկ անգամ կասկածի տակ է դնում Ավետիք Չալաբյանի նկատմամբ իրականացվող քրեական հետապնդման օրինականությունը և հիմք է տալիս ենթադրելու, որ թե՛ վարույթն իրականացնող մարմնի և թե՛ առայժմ այս փուլում մինչդատական և դատական վերահսկողության գործերով դատավորների նկատմամբ առկա է հստակ վարչահրամայական ճնշում։

«Համախմբում» շարժման անդամ, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանին անհիմն, առանց որևէ արժանահավատ ապացույցի և քրեադատավարական ընթացակարգերի կոպտագույն խախտումներով մեղսագրվում է ՀՀ քրեական օրենսգրքի 163-րդ հոդվածի 3-րդ մասի 2-րդ կետով նախատեսված արարքը։ Միտումնավոր հետապնդման և քաղաքական պատվերի դրսևորում է նաև այն փաստը, որ հայտնի ակնհայտ մոնտաժված ձայնագրության հրապարակումից երեք օր անց Ավետիք Չալաբյանը շարունակել է իր բնականոն կյանքը, որևէ կերպ չմիջամտելով քննությանը, չթաքնվելով, սակայն, դա անտեսվել է և այնուամենայնիվ Ա․Չալաբյանի նկատմամբ անհասկանալի հիմնավորմամբ որպես խափանման միջոց է ընտրվել երկամսյա կալանքը:
