«Փաստ» օրաթերթը գրում է

Հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի կալանավորման որոշման դեմ բերված վերաքննիչ բողոքի քննության դատական նիստը երեկ հետաձգվեց և կշարունակվի այսօր: Չալաբյանի փաստաբանական թիմը միտումնավոր հետապնդման և քաղաքական պատվերի դրսևորում է համարում Չալաբյանին անօրինականորեն կալանավորելը, այն դեպքում, երբ «ակնհայտ մոնտաժված ձայնագրության հրապարակումից երեք օր անց Ավետիք Չալաբյանը շարունակել է իր բնականոն կյանքը՝ որևէ կերպ չմիջամտելով քննությանը:

Փաստաբան Արթուր Հարությունյանը նշեց, որ երեկ դատախազի կողմից, ըստ էության, որևէ հիմնավորում, փաստական տվ յալ, որը կհակադրվեր փաստաբանների կողմից ներկայացված վերաքննիչ բողոքին, հիմնավորումներին` կալանքի և հիմնավոր կասկածի մասով, դատարան չեն ներկայացվել: Նշենք, որ երեկվա դատական նիստին մասնակցել ու ծավալուն ելույթ է ունեցել նաև Ա. Չալաբյանը: Հարությունյանը երեկ մեջբերեց նրա հետևյալ միտքը. «Ես մեր երկրի քաղաքացին եմ, շահառուն, սեփականատերը, և եթե փորձեմ փախչել քննությունից, ապա փախչում եմ ինքս ինձանից»:

Ի դեպ, ուշագրավ էր փաստաբանների ներկայացրած դրվագը, երբ իրենք նիստի ժամանակ նշել են, որ հուլիսի մեկից Քրեական նոր օրենսգիրքն ուժի մեջ է մտնելու, որով Չալաբյանին մեղսագրվող արարքը չի համարվելու քրեական հանցագործություն: «Դատախազն ասում է` իմ տեղեկություններով, օրենսդրական նախաձեռնություն է իրականացվում, որ այդ արարքը նորից քրեականացվի»,- տեղեկացրեց փաստաբան Վարազդատ Հարությունյանը: Հիշեցնենք, որ օրեր առաջ Արցախի նախագահը, Արցախի ԱԺ նախագահը, մի քանի պատգամավորներ, ինչպես նաև Արցախի թեմի առաջնորդը կոչ էին արել չեղարկել Ավետիք Չալաբյանի կալանավորման որոշումը և արդար քննություն իրականացնել։

Չալաբյանին ազատ արձակելու համար երաշխավորագրեր էին ներկայացրել նաև ԱԺ պատգամավորներ Իշխան Սաղաթելյանը, Սեյրան Օհանյանը, Էլինար Վարդանյանը, Հայկ Մամիջանյանը, Տիգրան Աբրահամյանը, Վաչե Գաբրիելյանը և «Արար» հիմնադրամը։
