Երեխային լացացնելու համար աբովյանցի ամուսինը դաժան ծեծի է ենթարկել կնոջը, ապա կտրել է նրա ականջը

Կոտայքի մարզի ընդհանուր իրավասության դատարանում Վաղինակ Մկրտչյանի նախագահությամբ ավարտվել է Գեղամ Հ.-ի գործի դատական քննությունը:

40-ամյա Գեղամին մեղադրանք էր առաջադրված իր հետ փաստական ամուսնական հարաբերությունների մեջ գտնվող կնոջ՝ ազգությամբ ռուս Սվետլանայի առողջությանը միջին ծանրության, ինչպես նաև թեթև վնաս պատճառելու, նաև՝ պարզապես նրան ծեծելու համար՝ ՀՀ քրեական օրենսգրքի 113 հոդվածի 1-ին մասով՝ 2 դրվագ, 117 և 118 հոդվածներով:

Ըստ մեղադրանքի՝ Կոտայքի մարզի գյուղերից մեկում բնակվող Գեղամ Հ.-ն 2016 թվականի հունիսից իր տան սենյակներից մեկը տրամադրել է մշտական բնակության վայր չունեցող մի կնոջ՝ ՌԴ քաղաքացի Սվետլանային՝ դեռ վերջինիս հետ էլ մտել է փաստական ամուսնական հարաբերությունների մեջ:

2016 թվականի դեկտեմբերի 7-ին, ժամը 22-ի սահմաններում Գեղամը Սվետլանայի կողմից իր մանկահասակ երեխային վիրավորելու և լացացնելու պատճառով վիճաբանության մեջ է մտել Սվետլանայի հետ:

Վիճաբանության ընթացքում Գեղամը Սվետլանային գցել է հատակին, ոտքերով, ձեռքերով հարվածներ է հասցրել նրա մարմնի, գլխի տարբեր մասերին: Ապա, ըստ մեղադրանքի, Գեղամը նստել է Սվետլանայի վրա, բռնել է նրա ձեռքերից, իր մոտ եղած մկրատով կտրել է կնոջ մազերի փունջը և աջ ականջի վերևի հատվածը՝ Սվետլանայի առողջությանը պատճառելով առողջության տևական քայքայումով միջին ծանրության վնաս՝ աջ ականջախեցու վերին կեսի աճառների վնասումով:

Դրանից հետո՝ դեկտեմբերի 24-ին, ժամը 11-ի սահմաններում Գեղամը ցանկացել է Սվետլանային հեռացնել իր տանից, բայց Սվետլանան հեռանալու միտք չի ունեցել: Վիճաբանություն է սկսվել, որի ժամանակ Գեղամը ձեռքերով հարվածներ է հասցրել Սվետլանայի մարմնի տարբեր մասերին, ձեռքով քաշել է Սվետլանայի՝ նախկինում իր իսկ կողմից մկրատով վնասված ականջից, ինչի հետևանքով Սվետլանայի առողջությանը պատճառվել է առողջության կարճատև քայքայումով թեթև վնաս՝ աջ ականջախեցու առաջնային մակերեսի վերին կեսի աճառների վնասումով կտրած վերքի պատռվածքի ձևով:

Չկարողանալով Սվետլանային հեռացնել իր տանից՝ Գեղամը դեկտեմբերի 25-ին, ժամը 15-ին նորից վիճաբանել է նրա հետ, որի ընթացքում ձեռքերով մի քանի անգամ հարվածել է կնոջը՝ պատճառելով ֆիզիկական ցավ և առողջության թեթև վնասի հատկանիշներ չպարունակող՝ գլխի աջ քունքային շրջանի փափուկ հյուսվածքների սալջարդ վնասվածք:

Հաջորդ օրը՝ դեկտեմբերի 26-ին, Սվետլանան շրջել է Գեղամի տան վառարանը: Ժամը 16-ի սահմաններում Գեղամը դրա պատճառով վիճել է Սվետլանայի հետ, նրան հարվածել-գցել է գետնին, հետո ոտքերով հարվածել է Սվետլանայի ձախ ձեռքին՝ նրա առողջությանը պատճառելով տևական քայքայումով միջին ծանրության վնաս՝ ձախ նախաբազկի միջին երրորդականի փափուկ հյուսվածքների սալջարդի, արյունազեղման, ձախ ծղիկոսկրի միջին երրորդականի փակ, առանց տեղաշարժի կոտրվածքի ձևով:

Ըստ դատական ակտի՝ ստացած վնասվածքների պարագայում անգամ Սվետլանան ոչ միայն չի հեռացել Գեղամի տանից, այլ նաև հիշաչար չի եղել: Նա ընդհանուր իրավասության դատարանում խնդրել է… դադարեցնել Գեղամի քրեական հետապնդումը, նրան չդատել ու չդատապարտել, քանի որ ինքը… հաշտվել է նրա հետ: Գեղամը ևս հայտարարել է, թե հաշտվել է Սվետլանայի հետ:

Առաջին ատյանի դատարանը հաշտության հիմքով կարճել է քրեական գործի վարույթը, դադարեցրել է Գեղամ Հ.-ի քրեական հետապնդումը:

Որոշումն ուժի մեջ մտնելուց հետո գործով իրեղեն ապացույց ճանաչված մկրատը, որով կտրվել էր Սվետլանայի ականջը, ըստ դատական ակտի՝ կոչնչացվի:
