Ավետիք Չալաբյանը պահանջում է հրապարակել ձայնագրության ամբողջական, չմոնտաժված տարբերակը

Ընդդիմության կազմակերպած զանգվածային անհնազանդության ակցիաների ընթացքում ոստիկանների աշխատանքն աչքի էր ընկնում բռնությամբ, շատ հաճախ՝ հավաքների մասնակիցների նկատմամբ բիրտ ուժի կիրառմամբ:

«5165 շարժման» անդամ Մենուա Սողոմոնյանի գնահատմամբ՝ ոստիկանության աշխատողների շարքերում կան պարկեշտ անձնավորություններ, ովքեր համագործակցային են, իրենք էլ հասկանում են այս չարիքի իշխանության գործողությունների հետևանքները, բայց, ընդհանուր առմամբ կա համակարգային բնույթի շատ լուրջ խնդիր.

«Հենց այդ խնդիրը թույլ չի տալիս, որ այս մարդիկ, ովքեր ունեն ազգային դիմագիծ, կարողանան քաղաքական իշխանության առջև հեռանալու կոնկրետ հարց դնել, այնպես, ինչպես տեղի ունեցավ 98 թվականին, երբ ուժային բոլոր կառույցներն ու դրանց ղեկավարները տեսան, որ Արցախի հարցում պարտվողական քաղաքականություն է և ստիպեցին Լևոն Տեր-Պետրոսյանին հեռանալ: 

Ինչ վերաբերում է առանձին մարդկանց, մասնավորապես, կարմիր բերետավորների գործողություններին, ապա այդ մասին շատ է խոսվել, շատ գնահատականներ են տրվել, և ես միանում եմ այդ գնահատականներին: Ես ևս ականատես եմ եղել այդ բռնություններին, ինքս էլ ոստիկանական բաժանմունք բերման ենթարկելու դեպքերից մեկի ժամանակ հարված եմ ստացել: Հենց այսպիսի մարդկանց առկայությունն է արատավորում, իջեցնում ոստիկանության, իրավապահ համակարգի հեղինակությունը, գցում հանրային վստահությունը»,- 1or.am-ի հետ զրույցում ասաց Սողոմոնյանը:

Անդրադառնալով հանրային գործիչ Ավետիք Չալաբյանի կալանավորման գործին՝ Սողոմոնյանը նշեց.

«Մենք այստեղ տեսնում ենք ամբողջությամբ շինծու գործ՝ բոլոր առումներով: Փայլուն հասկանալով, որ այն արարքը, որը մեղսագրվում է Ավետիքին, գործող Քրեական օրենսգրքում այլևս չկա, դա հանցակազմ պարունակող արարք չէ, նրան կալանավորում են: Եվ որպես հիմնավորում բերում են ոչ թե փաստարկներ, այլ Քրեական դատավարության օրենսգրքում առկա հիմքեր, որոնք պարզապես կրկնօրինակած, արտագրած ձևով են: 

Շատ կարևոր է նաև այն հանգամանքը, որ գործը հարուցվել է քրեական դատավարության տեսանկյունից անթույլատրելի ապացուցողական բազայի՝ գաղտնալսված ձայնագրության հիման վրա, այն էլ մոնտաժված: Եվ Ավետիքը պահանջում է, որ հրապարակվի ամբողջական ձայնագրությունը, որում շատ պարզ կերևա, որ ինքը  որևէ մեկին նյութապես չի շահագրգռել՝ հավաքներին մասնակցելու համար: Եթե նույնիսկ դիտարկում ենք ձայնագրությունը, այն անձը, որն անընդհատ խոսում է փողի մասին, փաստացի ազատության մեջ է: 

Այսքանը, կարծում եմ, բավական է՝ հասկանալու համար, որ մեր դատաիրավական համակարգը բացարձակ անկախ չէ, ամբողջությամբ կախված է քաղաքական իշխանություններից: Նիկոլ Փաշինյանն իշխանության եկավ հենց այդ լոզունգներով, որ պետք է լինի արդարադատություն, ազատ, անկախ դատական համակարգ, բայց, փաստորեն, իր խոստումները ոչ միայն չի պահում, այլ շատ ավելի վատ վիճակ է հիմա»:
