Դատապարտում ենք փաստաբանի մասնագիտական գործունեությունը խոչընդոտելը․ ՓՊ

ՀՀ Փաստաբանների պալատը հայտարարություն է տարածել, որում խստորեն դատապարտում է փաստաբանի մասնագիտական գործունեությունը խոչընդոտելու դրսևորումները։ Հայտարարությունում ասվում է․

«Ոստիկանության բաժիններ փաստաբանների մուտքը խոչընդոտելու վերաբերյալ ՀՀ փաստաբանների պալատի փաստաբանների իրավունքների պաշտպանության հանձնաժողովն այսօր հրատապ կարգով քննարկել է փաստաբան Սուզաննա Խչեյանի ներկայացրած հաղորդումը՝ իր մասնագիտական գործունեությունը ՀՀ ոստիկանության Երևան քաղաքի վարչության Շենգավիթի բաժնի ծառայողների կողմից խոչընդոտելու վերաբերյալ:

Փաստաբանը, մասնավորապես, հայտնել է, որ նշված բաժնի ծառայողները տևական ժամանակ (ավելին քան մեկ ժամ) թույլ չեն տվել իրեն մուտք գործել ոստիկանության բաժին՝ իրավաբանական օգնություն ցուցաբերելու ազատությունը սահմանափակված իր վստահորդին: Իրավիճակի վերաբերյալ փաստաբանը հաղորդում է ներկայացրել Ոստիկանության Երևան քաղաքի օպերատիվ կառավարման կենտրոն (1-02) և Մարդու իրավունքների պաշտպանի աշխատակազմ, ինչպես նաև պարբերաբար տեղեկություններ է հաղորդել բերման ենթարկված քաղաքացիներին առաջնային իրավաբանական օգնություն ցուցաբերելու համար ՀՀ փաստաբանների պալատի կողմից ձևավորված փաստաբանների խմբի համակարգողին:

Ոստիկանության ծառայողները, որպես փաստաբանի մուտքն արգելելու պատճառաբանություն, ներկայացրել են ազատությունը սահմանափակված անձի՝ իրավաբանական օգնություն ստանալու ցանկություն չունենալը, որն ըստ փաստաբանի՝ հերքվել է վստահորդի հետ առանձնատեսակցության ժամանակ, և ինքը ստանձնել է նրա պաշտպանությունը: Ավելի ուշ՝ իր վստահորդին ոստիկանության այլ բաժին տեղափոխելուց հետո, ոստիկանության ծառայողները նաև փորձել են խոչընդոտել փաստաբանի ելքը ոստիկանության բաժնի վարչական շենքից:

Փաստաբանի ներկայացված տեղեկությունները հաստատվել են նաև ՀՀ փաստաբանների պալատի կողմից ձևավորված փաստաբանների խմբի համակարգողից և ՄԻՊ աշխատակազմից ստացված տվյալներով: Հիմք ընդունելով ներկայացված փաստական հանգամանքները, ինչպես նաև հաշվի առնելով ՀՀ փաստաբանների պալատի կողմից ձևավորված փաստաբանների խմբի համակարգողի կողմից ներկայացված տեղեկությունները վերջին շրջանում ոստիկանության բաժիններ տարատեսակ պատճառաբանություններով փաստաբանների մուտքը խոչընդոտելու դեպքերի մասին՝ ՀՀ փաստաբանների պալատի փաստաբանների իրավունքների պաշտպանության հանձնաժողովը՝

Խստորեն դատապարտում է փաստաբանի մասնագիտական գործունեությունը որևէ եղանակով խոչընդոտելու դրսևորումները՝ հիշեցնելով, որ այդպիսի գործելակերպն ուղղակիորեն վտանգում է անձանց սահմանադրությամբ երաշխավորված հիմնարար իրավունքները և ազատությունները,

Ոստիկանության ծառայողներին հորդորում է խստորեն հետևել օրենսդրական պահանջներին,

ՀՀ ոստիկանությանը կոչ է անում միջոցներ ձեռնարկել նմանատիպ դեպքերը բացառելու և մեղավոր անձանց պատասխանատվության ենթարկելու ուղղությամբ»:
