Երեխայի գործողությունները լրիվ իրավաչափ են եղել. իրավաբանը՝ 13-ամյա երեխային բերման ենթարկելու մասին

«Հայաստան» դաշինքի անդամ, իրավաբան Ռոբերտ Հայրապետյանը ֆեյսբուքյան իր էջում գրառում է կատարել այն մասին, որ կարմիր բերետավորները ոստիկանություն են տարել 13-ամյա անչափահաս երեխայի:

1or.am-ը կապ հաստատեց Հայրապետյանի հետ՝ ճշտելու դեպքի մասնրամասները.

«Եթե ուշադիր եք եղել, ես իմ գրառման մեջ նշել եմ՝ ոստիկանություն են բերել, ոչ թե բերման են ենթարկել, որովհետև երեխան վարչական իրավախախտումների վերաբերյալ օրենքի իմաստով պատասխանատվության ենթակա սուբյեկտ չէ: Երեխան Բժշկական համալսարանի մասնակցել է խաղաղ ակցիայի, որտեղից էլ նրան ոստիակության բաժանմունք են տարել: Հրապարակված լուսանկարում էլ ակնհայտ երևում է, որ երեխայի 15 տարին լրացած չէ, այսինքն՝ բերետավորները նրան ոստիականական մեքենան «դնելուց» առաջ տեսել են, որ մեքենա են տանում մի անձի, որին իրավունք չունեն տանելու: Նրան ոստիկանություն տանելը ոչ իրավաչափ է, բայց Էրեբունու բաժանմունքում, ի պատիվ բաժանմունքի աշխատակիցների, բավականին պրոֆեսիոնալ են աշխատել, վարչական որևէ գործընթաց, փաստաթղթավորում չի եղել, և ծնողի հետ կապ հաստատելուց հետո 13 տարեկան երեխային անմիջապես ազատ են արձակել բաժանմունքից: 

13 տարեկան երեխայի՝ ցույցերին մասնակցելու իրավաչափության վերաբերյալ հարցին Հայրապետյանը պատասխանեց.

««Հավաքների ազատության մասին» և «Երեխայի ազատության մասին» ՀՀ օրենքների համաձայն՝ անչափահասներն իրավունք ունեն մասնակցելու և անգամ անձամբ իրականացնելու բողոքի ակցիաներ, իհարկե, ծնողի համաձայնությամբ: Քանի որ ոստիկանությունում երեխայի մայրը ներկա էր, նշեց, որ ինքը տեղյակ է, որ իր երեխան մասնակցում է ցույցերի, այդ առումով որևէ խախտում չկա, երեխայի գործողությունները լրիվ իրավաչափ են եղել: Միակ մարմինը, որ պետք է պատասխանատվություն կրի երեխային ապօրինաբար ոստիկանություն բերելու համար, Ոստիկանության կարմիր բերետավորումների ստորաբաժանումն է»,- եզրաափակեց իրավաբանը:
