Արարատցի 15 տարեկան աղջիկը 55-ամյա տղամարդու «ձեռի տակ» զբաղվել է մարմնավաճառությամբ

1in.am\ Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանում Գագիկ Պողոսյանի նախագահությամբ ավարտվեց Աշոտ Դաշտոյանի գործի դատական քննությունը:

Նախկինում 10 անգամ դատապարտված Դաշտոյանը մեղադրվում էր երկու հանցավոր արարքների համար՝ գույքային օգուտ ստանալու նպատակով անչափահաս աղջկա օգտագործելով՝ պոռնկությամբ զբաղվելուն նպաստելու և սուտ մատնություն կատարելու համար՝ ՀՀ քրեական օրենսգրքի 262 հոդվածի 2-րդ մասի 6-րդ կետով և 333 հոդվածի 1-ին մասով:

Ըստ մեղադրանքի՝ տուժող անչափահաս աղջիկը՝ 1999 թվականին ծնված Ն. Կ.-ն 2014 թվականի օգոստոսին Վեդիից եկել է Երևան՝ առանց բնակության վայր ունենալու: Փողոցում հայտնված ու անտերության մատնված անչափահաս աղջկա ճանապարհին հանդիպել, նրա հետ ծանոթացել է հենց Աշոտ Դաշտոյանը: Նա աղջկան առաջարկել է ապրել իր տանը՝ վարձակալական հիմունքներով: Աղջիկը համաձայնել է:

Այնուհետև Դաշտոյանն աղջկան առաջարկել է զբաղվել մարմնավաճառությամբ՝ խոստանալով նրա համար հաճախորդներ ապահովել: Աղջիկը դարձյալ համաձայնել է:

Ըստ մեղադրանքի՝ Աշոտ Դաշտոյանը պարբերաբար աղջկա համար հաճախորդներ է գտել, որոնց հետ աղջիկը սեռական հարաբերություններ է ունեցել: Յուրաքանչյուր հաճախորդից Դաշտոյանը, առաջադրված մեղադրանքի համաձայն, վերցրել է 10 հազար դրամ, 5 հազարը տվել է աղջկան, մնացածը պահել է իրեն: Ըստ մեղադրանքի՝ 2015 թվականի օգոստոսի 7-ին Դաշտոյանը ոստիկանության բաժնում սուտ հաղորդում է տվել, թե իր ծանոթը Սարյան պուրակում իր նկատմամբ բռնություն է գործադրել ու իր տաբատի գրպանից հափշտակել է 5 հազար դրամ: Այնուհետև նույն ծանոթը դանակի սպառնալիքով պահանջել է ևս 80 հազար դրամ: Քննությամբ Դաշտոյանի հաղորդած տեղեկությունները չեն հաստատվել, այլ պարզվել է, որ նա կատարել է սուտ մատնություն:

Այս գործը Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի վարույթ է ընդունվել 2016 թվականի հոկտեմբերի 28-ին:

Դատարանի նշանակած նիստերը անընդհատ հետաձգվել են, քանի որ անչափահաս տուժողը չի ներկայացել դատարան: Ի վերջո դատարանը ստացել է պաշտոնական տեղեկություն, որ այս գործով տուժող աղջիկը՝ Ն. Կ.-ն հատել է ՀՀ պետական սահմանը և մեկնել է Հայաստանից՝ առանց գործի վարույթն իրականացնող մարմնին տեղյակ պահելու:

Նախաքննության ընթացքում Աշոտ Դաշտոյանն իրեն մեղավոր չի ճանաչել: Բայց դատարանում նա փոխեց դիրքորոշումը, հայտարարեց, թե իրեն մեղավոր է ճանաչում: Նրա միջնորդությամբ գործը քննվեց արագացված ընթացակարգով:

Մեղադրողը միջնորդեց Աշոտ Դաշտոյանին դատապարտել 4 տարի 6 ամիս ազատազրկման:

Պաշտպանը խնդրեց իր պաշտպանյալի նկատմամբ սահմանել մեղմ պատիժ, կիրառել պայմանական դատապարտություն, նրան իրական ազատազրկման չդատապարտել:

Դատարանը Աշոտ Դաշտոյանին մեղավոր ճանաչեց մեղսագրված երկու հանցավոր արարքների համար՝ ՀՀ քրեական օրենսգրքի 262 հոդվածի 2-րդ մասի 6-րդ կետով և 333 հոդվածի 1-ին մասով:

Աշոտ Դաշտոյանը վերջին հաշվով դատապարտվեց 4 տարի ազատազրկման: Պատժի սկիզբը՝ 2016 թվականի հունիսի 13-ից:
