Երևանի Արաբկիրի նախկին թաղապետի նկատմամբ իրականացվող քրեական հետապնդումը դադարեցվել է

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության ծանր հանցագործությունների քննության բաժնում քննվող քրեական գործի նախաքննության ընթացքում իրականացված քննչական և դատավարական այլ անհրաժեշտ գործողությունների արդյունքում բացահայտվել են Երևանի Արաբկիր թաղային համայնքի նախկին ղեկավարի կողմից պաշտոնեական լիազորությունները չարաշահելու դեպքեր: Նրան մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 308-րդ հողվածի 2-րդ մասով (երկու դրվագ): Այս մասին հաղորդագրություն է տարածել ՀՀ քննչական կոմիտեն։

«Քննությամբ ձեռք բերված տվյալների համաձայն, վերջինս 2005-2007թթ. զբաղեցնելով հիշյալ պաշտոնը և հանդիսանալով պաշտոնատար անձ՝ շահադիտական և անձնական այլ շահագրգռվածությունից ելնելով, չարաշահել է իր պաշտոնեական լիազորությունները, պաշտոնեական դիրքն օգտագործել է ծառայության շահերին հակառակ, որի արդյունքում ՀՀ հողային օրենսգրքի 60-րդ հոդվածի սահմանափակումների մեջ ընդգրկված «Արաբկիր» զբոսայգու տարածքից 1500 քմ մակերեսով հողատարածքն ուղիղ վաճառքով օտարվել է Արաբկիրի թաղապետարանի ենթակայության «Մաքուր Արաբկիր» ՓԲ ընկերության տնօրենին՝ իր սանիկին:

Բացի այդ, համայնքի նախկին ղեկավարը Երևանի «Արաբկիր» թաղային համայնքի ղեկավարի աշխատակազմ» համայնքային կառավարչական հիմնարկին սեփականության իրավունքով պատկանող՝ Երևան քաղաքի Թբիլիսյան 3/3 հասցեի 2734.6 քմ. մակերեսով շենք-շինությունները, կադաստրային արժեքից անհամեմատ ցածր գնով՝ 29.800.000 ՀՀ դրամով, ուղղակի վաճառքի ձևով օտարել է իր հորը, ինչի հետևանքով համայնքի իրավունքներին ու օրինական շահերին պատճառվել է էական վնաս: Հետագայում հիշյալ անշարժ գույքը բաժանվել է երկու գույքային միավորների և անհամեմատ բարձր արժեքներով օտարվել այլ անձանց:

Նախաքննության ընթացքում Երևանի Արաբկիր թաղային համայնքի նախկին ղեկավարը դիմում է ներկայացրել և խնդրել իր նկատմամբ իրականացվող քրեական հետապնդումը դադարեցնել՝ վաղեմության ժամկետներն անցած լինելու՝ ոչ արդարացնող հիմքով:

Համայնքի նախկին ղեկավարի կողմից պաշտոնեական դիրքի չարաշահման արդյունքում վնաս պատճառելու դեպքերով Երևան համայնքը քրեական գործով ճանաչվել է որպես տուժող, իսկ 450.340.462 ՀՀ դրամի չափով՝ քաղաքացիական հայցվոր:

2022 թվականի փետրվարի 22-ին որոշում է կայացվել վերջինիս նկատմամբ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով իրականացվող քրեական հետապնդումը դադարեցնելու մասին՝ հանցանքն ավարտված համարելու օրվանից վաղեմության ժամկետներն անցնելու՝ ոչ արդարացնող հիմքով:

Վարույթն իրականացնող մարմնի կողմից՝ ոչ արդարացնող հիմքով կայացված որոշման հիման վրա Երևան համայնքին պատճառված վերոնշյալ չափով գումարը վերականգնելու մասով ձեռնարկվել են անհրաժեշտ գործողություններ՝ հայցի ապահովման միջոցներ կիրառելու ուղղությամբ»,-ասված է հաղորդագրության մեջ:
