Ընտրական հանձնաժողովի անդամի կեղծ վկայականներ՝ Լոռիում. մարզի դատախազը ԿԸՀ-ին միջնորդագիր է հասցեագրել

2021թ. մայիսի 31-ին ՀՀ ոստիկանության Տարոնի բաժնում ՀՀ քրեական օրենսգրքի 325-րդ հոդվածի 1-ին մասով հարուցված քրեական գործով ՀՀ ՔԿ Լոռու մարզային վարչությունում կատարված նախաքննությամբ հիմնավորվել է, որ համապատասխան պայմանագրի հիման վրա ՀՀ կենտրոնական ընտրական հանձնաժողովի կողմից գործուղղված դասընթացավարը ընտրությունների մասնագիտական դասընթաց և որակավորման ստուգարքներ անցկացնելու շրջանակներում կազմել է պաշտոնական փաստաթուղթ, որում բովանդակությամբ կեղծ տեղեկություններ է ներառել 4 անձի կողմից իր վարած դասընթացին մասնակցելու, հարցաթերթիկ լրացնելու և դրական գնահատական ստանալու մասին: Դրանց հիման վրա վերջիններս իրավունք են ստացել հանդիսանալ տեղամասային ընտրական հանձնաժողովի անդամ:

Մինչդեռ, նախաքննությամբ հաստատվել է, որ հիշյալ 4 անձինք դասընթացին և որակավորման ստուգարքին չեն մասնակցել, քանի որ տվյալ ժամանակահատվածում գտնվել են Երևան քաղաքում: 

ՀՀ կենտրոնական ընտրական հանձնաժողովից ստացված գրության համաձայն՝ թեև նշված անձինք ստացել են տեղամասային ընտ­րական հանձնաժողովում ընդգրկվելու որակավորման վկայական, սակայն դրա հիման վրա որևէ անգամ չեն ընդգրկվել հանձնաժողովի կազ­մում:

Վարույթն իրականացնող մարմինը գտել է, որ թեև դասընթացավարի գործողությունները ձևականորեն պարունակել են փաստաթղթերի կեղծման հանցագործության հատկանիշներ, սակայն այդ արարքը լուրջ հանրային վտանգավորություն չի ներկայացրել, քանի որ՝ որպես հետևանք՝ հասարակությանը կամ պետությանը էական վնաս չի պատճառվել, հիշյալ անձինք որևէ անգամ չեն ընդգրկվել տեղամասային ընտրական հանձնաժողովի կազմում:

Բացի այդ, քննությամբ տվյալներ չեն ստացվել նաև այդ 4 անձանց կողմից ընտ­րական հանձնաժողովում ընդգրկվելու որակավորման վկայականն այլ նպատակներով օգտագործելու, ինչպես նաև պաշտոնական փաստաթուղթ կեղծելու կապակցությամբ դասընթացավարին օժանդակելու վերաբերյալ:

Ելնելով դրանից՝ կայացվել է վարույթը կարճելու և քրեական հետապնդում չիրականացնելու որոշում:

Այդուհանդերձ քրեական գործի նախաքննությամբ հաստատվել է, որ վերը նշված դասընթացի կազմակերպման և անցկացման գործընթացում տեղ են գտել ակնհայտ թերություններ և բացթողումներ: Մասնավորապես՝ չի պահպանվել որակաորման վկայական ստանալու համար կազմակերպված դասընթաց անցկացնելու և ստուգարք ընդունելու կարգը, առերևույթ կատարվել է փաստաթղթին կեղծիք:

Ելնելով դրանից՝ ՀՀ Լոռու մարզի դատախազը միջնորդագիր է հղել ՀՀ կենտրոնական ընտրական հանձնաժողովի նախագահին: Հաշվի առնելով ընտրական գործընթացների օրինականության ապահովման՝ պետության և հասարակության համար բացառիկ կարևորությունը՝ մարզի դատախազն առաջարկել է անհրաժեշտ միջոցառումներ ձեռնարկել ընտրությունների անցկացման մասնագիտական դասընթացների և որակավորման ստուգարքներ ընդունելու գործընթացը սահմանված կարգին համապատասխան և վերահսկողության պայմաններում իրականացնելու, դրանց չմասնակցելու պայմաններում անձանց կողմից որակավորման վկայական ստանալու հնարավորությունը բացառելուն ուղղված մեխանիզմներ կիրառելու ուղղությամբ:
