Օտարերկրյա ներդրողների իրավունքները շարունակվում են մնալ խախտված

Դեկտեմբեր ամսին տեղեկացրել էինք, որ Հայաստանը կրկին ներդրումային խոշոր վեճի շեմին է:

2021 թվականի հոկտեմբերի 6-ին «Անսուր Ինվեստ» ՍՊ Ընկերության օտարերկյա ներդրողներ հանդիսացող Ռուսաստանի և Գերմանիայի քաղաքացիների կողմից Հայաստանի Կառավարությանն է ուղարկվել ծանուցում առ այն, որ առկա է ներդրումային վեճ, որը վեցամսյա ժամեկտում չլուծվելու պարագայում վերջիններս պատրաստվում են դիմել միջազգային արբիտրաժային դատարան, քանի որ Հայաստանը խախտել է մի շարք միջազգային պայմանագրերի շրջանակներում ստանձնած պարտավորություններ՝ ապահովելու օտարերկրյա ներդրումների իրավական պաշտպանությունը և անվտանգությունը:

Վեճի առարկան է հանդիսանում «Կասկադի» մոտակայքում՝ Անտառային փողոց հասցեում գտնվող գույքային միավորը, որը փաստացի հափշտակվել է օտարերկրյա ներդրողների տեղական գործընկերների կողմից, իսկ Հայաստանի իրավապահ մարմինները և դատարանները փաստացի օժանդակել են այդ շարունակական իրավախախտ գործելաոճին՝ թույլ տալով արդարադատության ակնհայտ մերժում, և էքսպրորիացիայի ենթարկելով օտարերկրյա ներդրումները՝ սկսած 2005 թվականից:

Այսինքն, ավելի քան տասներեք տարի է, օտարերկրյա ներդրողները չեն կարողանում վերականգնել Հայաստանի կողմից խախտված՝ իրենց ներդրումային իրավունքները:Ներկայումս վեճի առարկա վերոնշյալ գույքը Արդարադատության նախարարության կողմից հանվել է հարկադիր էլեկտրոնային աճուրդի, ինչի մասին տեղեկանալով օտարերկրյա ներդրողները 2021 թվականի դեկտեմբերի 17-ին դիմել են Կառավարությանը պահանջով կասեցնել աճուրդը: Սակայն, աճուրդը և կատարողական վարույթը կասեցնելու փոխարեն պետությունն էլ ավելի է վատթարացրել իրավիճակը՝ խորացնելով առկա վեճը: Մասնավորապես, աճուրդը չկայանալուց հետո գույքի արժեքը էականորեն նվազեցվել է, և այն կրկին հանվել է աճուրդի:

Ակներև է, որ վեճի առարկա այս գույքի վաճառքը պետք է անհապաղ դադարեցնել, քանի որ այն հանդիսանում է վեճի առարկա և դրա իրացումը հետագայում անխուսափելիորեն խնդիրներ է առաջացնելու նաև գնորդների համար:Ներկայումս օտարերկրյա ներդրողների և Հայաստանի համապատասխան իրավասու մարմինների միջև բանակցությունները շարունակվում են:

Չնայած որ բանակցությունները, փաստորեն, անարդյունավետ են, ներդրողներն, այնուամենայնիվ, նպատակահարմար են գտնում ամեն ջանք գործադրել վեճը հաշտությամբ լուծելու համար:
