Պատերազմի առնչությամբ քրգործով մեղադրյալ գումարտակի հրամանատարի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը

Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարանը նոյեմբերի 8-ի որոշմամբ բավարարել է Ադրբեջանի Հանրապետության ռազմաքաղաքական ղեկավարության կողմից Արցախի Հանրապետության դեմ ագրեսիվ պատերազմ սանձազերծելու և վարելու դեպքի առթիվ քննվող քրեական գործով որպես մեղադրյալ ներգրավված հրաձգային գումարտակի հրամանատարի նկատմամբ կալանքը որպես խափանման միջոց ընտրելու մասին միջնորդությունը, տեղեկացնում է ՀՀ դատախազության հանրային կապերի բաժինը։

Նշված քրեական գործի նախաքննությամբ պարզվել է, որ վերջինս, հանդիսանալով իր ենթակա անձնակազմի պետը՝ 2020թ․նոյեմբերի 9-ին արցախյան պատերազմում հրադադարի հաստատման եռակողմ հայտարարության ընդունումից հետո հրաման է ստացել մարտական հերթապահություն կատարելով ապահովել Արցախի Հանրապետության Հադրութի շրջանի Հին Թաղեր տեղամասի արևելյան սահմանի թվով 12 մարտական դիրքերի անվտանգությունը։ 2020թ. դեկտեմբերի 11-ից 12-ն ընկած ժամանակահատվածում տեղի ունեցած մարտական գործողությունների ընթացքում նշված դիրքերն անցել են թշնամու վերահսկողության տակ, թիվ N մարտական դիրքում տեղակայված անձնակազմի 11 զինծառայողները հայտնվել են շրջափակման մեջ,  որոնցից ինը զոհվել է, երկուսը՝ գերեվարվել:

Նախաքննությամբ ձեռք բերված փաստական տվյալների բավարար համակցության հիման վրա 2021թ․ապրիլի 30-ին հրաձգային գումարտակի հրամանատարին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 376-րդ հոդվածի 3-րդ մասով։ Նրա նկատմամբ որպես խափանման միջոց կալանավորումն ընտրելու վերաբերյալ միջնորդություն էր ներկայացվել Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարան, որի 2021 թվականի մայիսի 1-ի որոշմամբ միջնորդությունը մերժվել էր:

Քրեական գործով մինչդատական քրեական վարույթի օրինականության նկատմամբ հսկողություն իրականացնող դատախազի կողմից վերոնշյալ որոշումը բողոքարկվել էր ՀՀ վերաքննիչ քրեական դատարան, որի 2021 թվականի հուլիսի 14-ի որոշմամբ բողոքը բավարարվել է և գործն ուղարկվել է Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարան` նոր քննության:

Արդյունքում Առաջին ատյանի դատարանի 2021թ․ նոյեմբերի 8-ի որոշմամբ մեղադրյալի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
