Համայնքների նախկին 2 ղեկավար դատի է տրվել

ՀՀ մարզերի դատախազությունների կողմից պետական շահերի պաշտպանության հարցադրումներով կատարված ուսումնասիրությունների հիման վրա գրեթե բոլոր մարզերի բազնաթիվ ՏԻՄ-երի պաշտոնատար անձանց կողմից համայքային հողատարածքները վարձակալության հանձնելու գործընթացներում կոռուպցիոն առերևույթ չարաշահումների դեպքերով նախապատրաստված նյութերով հարուցվել են քրեական գործեր:

Մասնավորապես, Կոտայքի մարզի դատախազության դատախազների հսկողության ներքո նմանատիպ փաստերի կապակցությամբ հարուցվել է ընդհանուր առմամբ 4 քրեական գործ, որոնք վերաբերում են մարզի Գառնի համայնքին, Չարենցավան խոշորացված համայնքի Կարենիս բնակավայրին, Մեղրաձոր խոշորացված համայնքին և նշված համայնքի Արտավազ բնակավայրին:

Այս քրեական գործերով կատարված քննությամբ պարզվել է, որ սկսած 2004թ.-ից՝ համայնքների ղեկավարները, երբեմն նախապես տեղեկանալով այդ համայնքների տարածքում հեռահաղորդակցության ծառայություններ մատուցող ընկերությունների կողմից բջջային կապի ալեհավաք կայաններ տեղադրելու և շահագործելու մտադրության մասին, պետական կամ համայնքապատկան գյուղատնտեսական նշանակության հողամասերը շուկայականից էականորեն ցածր՝ սիմվոլիկ վճարներով վարձակալության են հանձնել տարբեր ֆիզիկական անձանց, այդ թվում նաև իրենց հարազատներին, մերձավորներին: Դրանից հետո որոշ ժամանակ անց վերջիններիս կողմից այդ հողամասերը կամ դրանց առանձին մասերը բազմապատիկ անգամ բարձր վարձավճարներով ենթավարձակալության են հանձնվել նշված ընկերություններին, որոնք այն օգտագործել են որպես կապի օբյեկտի հող:

Հետագայում միջոցներ չեն ձեռնարկվել ապօրինի հողօգտագործումները կասեցնելու, վերացնելու ուղղությամբ:

Արդյունքում հողամասերի վարձակալները երկար տարիներ պայմանագրերի հիման վրա համայնքային սեփականության հողամասերի օգտագործումից իրենց համար վարձավճարների տեսքով ապահովել են խոշոր չափերով շահույթներ, իսկ համայնքները զրկվել են ֆինանսական այդ աղբյուրից օգտվելու հնարավորությունից: Նշված հանցավոր արարքները կատարելու համար քրեական գործերով որպես մեղադրյալ է ներգրավվել 5 անձ, որոնցից 3-ը՝ նշված համայնքների նախկին ղեկավարներ:

Հարուցված վերոնշյալ 4 քրեական գործերից 2-ը՝ 4 անձի վերաբերյալ մեղադրական եզրակացությամբ ուղարկվել է դատարան: Դրանցից մեկով դատական քննությունը շարունակվում է, մյուսով կայացվել է արդարացման դատական ակտ, որը մարզի դատախազության կոմղից բողոքարկվել է ՀՀ վերաքննիչ դատարան: Իսկ 2 քրեական գործով նախաքննությունը դեռևս շարունակվում է:

Քննությունների արդյունքում պարզված համայնքներին պատճառված ընդհանուր նախնական վնասը կազմել է շուրջ 36.2մլն ՀՀ դրամ: Տարված աշխատանքների արդյունքում դրանից վերականգնվել է շուրջ 5.6մլն ՀՀ դրամը, միջոցներ են ձեռնարկվում վնասների մնացած մասը ևս վերականգնելու ուղղությամբ:

Համայնքներից 3-ի պարագայում լուծվել է հանցավոր գործարքների միջոցով կնքված վարձակալության և վարձակալների կողմից հեռահաղորդակցության ծառայություններ մատուցող ընկերությունների հետ կնքված ենթավարձակալության 3 պայմանագիր, որից հետո 2 դեպքում համայնքների և նույն ընկերությունների միջև կնքվել են նոր պայմանագրեր: Իսկ մեկ դեպքում պայմանագրի կնքման գործընթացը գտնվում է ընթացքի մեջ՝ պայմանավորված հողամասի նպատակային նշանակության փոփոխմագործընթացով:
