Նախատեսվում է փոփոխել գնումների գործընթացների բողոքարկման կարգը

Հոկտեմբերի 20-ի հերթական նիստում ԱԺ տնտեսական հարցերի մշտական հանձնաժողովը Վահե Հակոբյանի նախագահությամբ  առաջին ընթերցմամբ քննարկել է  ««Գնումների մասին» օրենքում փոփոխություններ եւ լրացումներ կատարելու մասին» օրենքի նախագիծը՝ կից փաթեթով:

ՀՀ ֆինանսների նախարարի տեղակալ Ավագ Ավանեսյանի տեղեկացմամբ՝ նախաձեռնության նպատակը գնումների գործընթացների հետ կապված բողոքների քննությունն է, ինչն առաջարկված փաթեթով նախատեսվում է վերապահել մասնագիտացված դատարանին:  Սա պայմանավորված է նաեւ այն հանգամանքով, որ Առեւտրի համաշխարհային կազմակերպության  եւ Եվրամիության հետ կնքված համաձայնագրով Հայաստանը պարտավորվել է  ձեւավորել անկախ մարմին, որը պետք է քննի գնումների հետ կապված բողոքները:

Գործող կարգավորմամբ՝ գնման ընթացակարգի արդյունքները կարող են բողոքարկվել  արտադատական եւ դատական կարգով: Բողոք ներկայացնելու հնարավորություն ունի ցանկացած անձ:

Ուսումնասիրությունները  ցույց են տվել, որ արտադատական բողոքարկման համակարգն արդյունավետ չէ. կայացվող որոշումները գնումների մասին ՀՀ օրենսդրության տեսանկյունից խնդրահարույց են, կայացվում են միմյանց հակասող որոշումներ, որոնք բողոքարկվում են դատարաններում, կամ գնման ընթացակարգերը հայտարարվում են չկայացած: Ուստի առաջարկվում է սահմանել, որ գնումների գործընթացների հետ կապված բողոքները պետք է քննվեն մեկ  առանձնացված  դատարանում: Նման գործերի քննությամբ կզբաղվեն  երկու վերապատրաստված դատավորներ:

Փաթեթի ընդունումից հետո կվերանա գնումների ընթացակարգերի բողոքարկման  հետ կապված գործերի արտադատական կարգով քննությունը: Խնդրահարույց է համարվել նաեւ բողոք ներկայացնելու հնարավորություն ունեցող անձանց լայն շրջանակը, հետեւաբար փաթեթով նախատեսվում է բողոք ներկայացնելու հնարավորություն ընձեռել միայն շահագրգիռ անձանց:

Փաթեթը հանձնաժողովի դրական եզրակացությամբ կառաջարկվի ընդգրկել ԱԺ նստաշրջանի օրակարգի նախագծում:

Փաթեթի քննարկումը  նախատեսվում է իրականացնել նոյեմբերի 16-ին մեկնարկող ԱԺ հերթական նիստերի ընթացքում:
