ԱԺ արտահերթ ընտրություններում ընտրակաշառքի վերաբերյալ առաջին գործով մեղադրական դատավճիռ է կայացվել

2021թ. հունիսի 19-ին ՀՀ քրեական օրենսգրքի 154․2-րդ հոդվածի 1-ին և 2-րդ մասերի հատկանիշներով հարուցված քրեական գործի՝ ՀՀ ՀՔԾ-ում կատարված նախաքննությամբ ձեռք բերված բավարար ապացույցների համակցությամբ հիմնավորվել էր, որ  2021թ. հունիսի 20-ին նշանակված ՀՀ Ազգային ժողովի արտահերթ ընտրություններին մասնակցող «Պատիվ ունեմ» կուսակցությունների դաշինքով, ի թիվս այլոց, որպես պատգամավորի թեկնածու է առաջադրվել նաև Լոռու մարզի Արջուտ գյուղի բնակչուհի Ն. Ա.-ի գործատու ՍՊ ընկերության բաժնետիրոջ որդին, տեղեկացնում է Գլխավոր դատախազությունը:

2021թ. հունիսի 18-ին՝ ժամը 20:30-ի սահմաններում, Ն. Ա.-ն՝ արտահերթ ընտրություններին «Պատիվ ունեմ» դաշինքի օգտին կողմ քվեարկելու նպատակով համագյուղացուն՝ ընտրող, նույն գյուղի մի բնակչուհու անձամբ առաջարկել է 10000-ից մինչև 20000 ՀՀ դրամի չափով ընտրակաշառք, սակայն վերջինս մերժել է: Րոպեներ անց Ն. Ա.-ն Արջուտ գյուղում գտնվող իր բնակարան է հրավիրել մեկ այլ համագյուղացու և «Պատիվ ունեմ» դաշինքի օգտին կողմ քվեարկելու համար անձամբ որպես առավելություն, խոստացել է զիջել նախկինում՝ ծառայություններ մատուցելու արդյունքում գոյացած 7500 ՀՀ դրամի չափով պարտքը:

Վերոնշյալ հանցավոր արարքները կատարելու համար Ն. Ա.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 154․2-րդ հոդվածի 4-րդ մասի 2-րդ կետով: Առաջադրված մեղադրանքի վերաբրեյալ նա տվել է խոստովանական ցուցմունքներ, վերջինիս նկատմամբ որպես խափանման միջոց ընտրվել է չհեռանալու մասին ստորագրություն։

2021թ. հուլիսի 2-ին ՀՀ գլխավոր դատախազությունից քրեական գործը մեղադրական եզրակացությամբ ուղարկվել է Լոռու մարզի առաջին ատյանի ընդհանուր իրավասության դատարան՝ ըստ էության քննելու նպատակով։

Դատական քննության արդյունքում Առաջին ատյանի դատարանի՝ 2021թ. հոկտեմբերի 11-ի դատավճռով ամբաստանյալ Ն. Ա.-ն մեղավոր է ճանաչվել իրեն մեղսագրված հանցանքը կատարելու համար, և նրա նկատմամբ պատիժ է նշանակվել 4 տարի ժամկետով ազատազրկում, այնքան, որքան միջնորդել էր մեղադրող դատախազը։

Միաժամանակ, դատարանը ՀՀ քրեական օրենսգրքի 70-րդ հոդվածի կարգով ամբաստանյալի նկատմամբ նշանակված պատիժը պայմանականորեն չի կիրառել՝ սահմանելով փորձաշրջան 5 տարի ժամկետով։

Դատական ակտն ստանալուց հետո ՀՀ գլխավոր դատախազությունում կքննարկվի պատիժը պայմանականորեն չկիրառելու մասով այն բողոքարկելու հիմքերի առկայությունը և անհրաժեշտությունը:
