Շիրակի մարզի Զարիշատ համայնքի նախկին ղեկավարը համայնքապատկան հողամասերը ապօրինի կերպով հանձնել է վարձակալության. նրան մեղադրանք է առաջադրվել. Դատախազություն

Դատախազության հետևողական հսկողության ներքո ՀՀ Շիրակի մարզային քննչական վարությունում քննված քրեական գործով իրականացված նախաքննության ընթացքում ձեռք են բերվել բավարար ապացույցներ այն մասին, որ  Շիրակի մարզի Զարիշատ համայնքի նախկին ղեկավար Հ․Խ․-ն պաշտոնավարման ընթացքում, նախապես տեղեկացված լինելով հեռա­հաղորդակցության օպերատոր ընկերութ­­յան կողմից համայնքի տա­րած­քում ալեհավաք կայան տեղա­դրելու, շահագործելու մտադրության մասին՝ 2007թ․դեկտեմբերի 25-ին Շիրակի մարզի Ամասիա համայնքի բնակիչ, իր ծանոթ, կադաստրի պետական կոմիտեի աշխատակից Հ․Հ․-ի հետ կնքել է գյուղատնտեսական գործունեություն ծավալելու նպատակով հողամասերը վարձակալության հանձնելու մասին պայմանագիր։ Դրանով վերջինս Զարիշատ համայնքից վարձակալել է համայնքի վարչական տարածքում գտնվող՝ գյուղատնտեսական նշանակության 2.5 հա մակերեսով հողատարածք՝ 25 տարի ժամկետով՝ տարեկան 12.720 ՀՀ դրամ վարձավճարով: Այս մասին հայտնում է Դատախազությունը:

Մեկ օր անց՝ 2007թ․ դեկտեմբերի 26-ին, համայնքի ղեկավարը տվել է իր համաձայնությունը նշված 2.5 հա գյուղատնտեսական նշանակության նշված հողամասից որևէ տարածք ենթավարձակալությամբ տալուն, և նույն օրը Հ․Հ․-ն իր վարձակալած հողամասից 0,04 հա հողատարածքը ենթավարձակալությամբ հանձնել է բջջային օպերատոր ընկերությանը 24 տարի ժամկետով` ամսական 40.000 ՀՀ դրամ վարձավճարով:

Նշված գյուղատնտեսական նշանակության հողատարածքում տեղադրվել և շահագործվել է ալեհավաք կայան, իսկ համայնքի ղեկավարի գործողությունների արդյունքում Հ․Հ․-ի ընտանիքը մինչև 2016թ․հոկտեմբերի 6-ը ներառյալ ստացել է առանձնապես խոշոր չափերի՝ ընդհանուր 4.215.482 ՀՀ դրամ վարձավճարի տեսքով շահույթ, այսինքն համայնքը  զրկվել է այդ չափով եկամուտ ստանալու հնարավո­րութ­յունից:

Նշված հանցավոր արարքները կատարելու համար Զարիշատ համայնքի նախկին ղեկավար Հ․Խ․-ին առաջադրվել է մեղադրանք ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով։ Նախաքննության ընթացքում նրա կողմից ներկայացվել է պատճառված վնասի վերականգնման մասին վճարման անդորրագիր, որի համաձայն՝ որպես պատճառված վնաս,  վերականգնվել է 1.000.000 ՀՀ դրամ:
