ՀՀ–ում էլեկտրոնային ծառայություններ մատուցողներն ավելացված արժեքի հարկ կվճարեն

Կառավարությունը հավանություն տվեց Հարկային օրենսգրքում փոփոխությունների նախագծին, որի հիմնական նպատակը ՀՀ հարկային օրենսգրքով էլեկտրոնային ծառայության հասկացության սահմանման հստակեցումն է:

«Արմենպրես»-ի փոխանցմամբ՝ օրինագծի նպատակն է նաև էլեկտրոնային ծառայությունների մատուցման վայրի որոշման կանոնների սահմանումը, ինչպես նաև ոչ ռեզիդենտ կազմակերպության կողմից անհատ ձեռնարկատեր կամ նոտար չհամարվող ֆիզիկական անձին մատուցվող էլեկտրոնային ծառայությունների մասով ԱԱՀ-ի հաշվարկելու և վճարելու կարգավորումների նախատեսումն է:

Պետական եկամուտների կոմիտեի նախագահ Ռուստամ Բադասյանը նշեց, որ այս նախագծով կարգավորել են ՀՀ-ում մշտական հաստատություն չունեցող ոչ ռեզիդենտ ընկերությունների կողմից ՀՀ-ում գտնվող ֆիզիկական անձանց էլեկտրոնային հարկման հետ կապված հարաբերությունները:

«Ներկայումս համապատասխան կարգավորման բացակայության պատճառով պետական բյուջեն կորցնում է միջոցներ ավելացված արժեքի հարկի գծով»,- ասաց նա:

Մասնավորապես, նախագծով առաջարկվում է.

1) սահմանել ՀՀ հարկային օրենսգրքի կիրառման իմաստով էլեկտրոնային ծառայության հասկացությունը` հաշվի առնելով այդ ոլորտի կարգավորման մասով ներկայումս ԵԱՏՄ պայմանագրի 18-րդ հավելվածում նախատեսվող փոփոխությունները,

2) կարգավորել ՀՀ-ում մշտական հաստատություն չունեցող ոչ ռեզիդենտ հարկ վճարողների կողմից անհատ ձեռնարկատեր կամ նոտար չհամարվող ֆիզիկական անձանց ՀՀ տարածքում էլեկտրոնային ծառայության մատուցման դեպքում ԱԱՀ-ով հարկման հարցերը:

Նախագծով ոչ ռեզիդենտ կազմակերպության կողմից անհատ ձեռնարկատեր կամ նոտար չհամարվող ֆիզիկական անձին մատուցվող էլեկտրոնային ծառայությունների մասով ծառայության մատուցման պահը որոշվում է այդ ծառայության դիմաց վճարում, այդ թվում` մասնակի, կատարելու օրը ներառող հաշվետու եռամսյակի վերջին օրը ներառյալ:

ՀՀ տարածքում էլեկտրոնային ծառայություններ մատուցող ոչ ռեզիդենտ հարկ վճարողների մասով Կառավարության կողմից սահմանվում է հարկային մարմնում հաշվառման և ԱԱՀ-ի վճարման պարզեցված ընթացակարգ։

Նախագծի ընդունման արդյունքում ակնկալվում է էլեկտրոնային ծառայությունների մատուցման գործարքների մասով ՀՀ հարկային օրենսգրքով համապատասխան կարգավորումների սահմանում։ Ոչ ռեզիդենտ կազմակերպությունների կողմից ֆիզիկական անձանց մատուցվող էլեկտրոնային ծառայությունների մասով ԱԱՀ-ի գծով լրացուցիչ հարկային մուտքերի ապահովում:
