Դատավոր Մնացական Հարությունյանի կամքը շատ թույլ է, կասկածում եմ, որ դեմ կգնա իշխանություններին և կկայացնի նրանց ոչ հաճո որոշում․ Առուշանյանի պաշտպան (տեսանյութ)

Այսօր ժամը՝ 17։30-ին, Առուշ Առուշանյանի գործով հայտարարվել է նախաքննության ավարտ։ Առուշանյանի պաշտպան Էրիկ Ալեքսանյանը լրագրողների հետ զրույցում ասաց, որ այլևս որևէ կերպ չի կարող խոսք լինել քննությանը խոչընդոտելու և կալանավորման հիմքի գոյության մասին, թեև այն ի սկզբանե չի էլ եղել։

«Մենք գիտենք, որ քննության սկզբնական փուլի ավարտվելուց հետո, երբ բոլոր ապացույցները հավաքվում են, գնահատականներ են տրվում և բոլոր այն մտավախությունները, որոնք նախկինում ունեցել է վարույթ իրականացնող մարմինը, դրանք կա՛մ ի սպառ վերանում են, կա՛մ էապես նվազում են։ Մենք գործ ունենք, եթե ոչ հիմքի ի սպառ բացակայության հետ, ապա գոնե նվազման հետ և Առուշանյանի կալանքի տակ մնալը չի կարող օրինական լինել ստեղծված պայմաններում»,-ասաց Էրիկ Ալեքսանյանը։

Նա նաև նշեց, որ այս պահին վերաքննիչ դատարանում նշանակված է դատական նիստ օգոստոսի 2-ին, որտեղ դատարանը քննության է առնելու պաշտպանների բողոքը։

«Վերաքննիչ դատարանը օրենսդրության համաձայն պետք է գնահատի առաջին ատյանի դատարանի որոշումը, այն նյութերի շրջանակներում, որոնց շրջանակներում դատարանը որոշում է կայացրել և սա նոր հանգամանք է, որ նախաքննության ավարտ է նշանակվել և, ըստ էության, Եվրոպական դատարանի որոշումների համաձայն՝ քննությանը խոչընդոտելու հիմքն արդեն իսկ նվազում է, և մենք կհայտնենք այս հանգամանքը դատարանին»,- նշեց նա։

Պաշտպանը նաև ընդգծեց, որ իրենք մարտական են տրամադրված և օգոստոսի 2-ին պատրաստվում են ներկայանալ դատարան։ «Դատավորը Մնացական Հարությունյանն է, որի մասին ունեմ օբյեկտիվ երկու կարծիք՝ նա պատրաստված դատավոր է և ունի բարձր մակարդակի տեսական գիտելիքներ, բայց այդ, դատավորի կամքը շատ թույլ է, և ես դա տեսել եմ և կարծում եմ, որ նա դեմ չի գնա իշխանություններին և չի կայացնի նրանց համար ոչ հաճո որոշում»,- ընդգծեց պաշտպանը։
