Վերաքննիչ դատարանն ավարտել է Ռոբերտ Քոչարյանի գործով պաշտպանների և դատախազության միջնորդության քննարկումը․ որոշումը կհրապարակվի այսօր

Վերաքննիչ քրեական դատարանը` նախագահությամբ դատավոր Նարինե Հովակիմյանի, այսօր շարունակել է սահմանադրական կարգի ենթադրյալ տապալման գործի կարճման վերաբերյալ պաշտպանների և դատախազների բողոքների գործով դատական նիստը։

Մասնավորապես, դատարանն այսօր լսել է պաշտպանական կողմի դիրքորոշումը դատախազ Գևորգ Բաղդասարյանի՝ գործի վարույթը կասեցնելու և ՍԴ դիմելու միջնորդության վերաբերյալ։ Պաշտպանները պնդել են, որ գործը կասեցնելու և ՍԴ դիմելու հիմքեր չկան, և խնդրել, որ միջնորդությունը մերժվի։

«ՍԴ որոշումից հետո, երբ փաստացի ապաքրեականացվել է Քրեական օրենսգրքի 300.1-րդ հոդվածը, դատարանն ունեցել է իմպերատիվ պարտականություն՝ քրեական հետապնդումը դադարեցնելու և քրեական գործի վարույթը կարճելու մասին»,- նշել է ՀՀ նախկին փոխվարչապետ Արմեն Գևորգյանի պաշտպան Էրիկ Ալեքսանյանը:

ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի պաշտպան Արամ Օրբելյանն, իր հերթին, ընդգծել է, որ գործի քննության այս փուլում, քանի դեռ դատարանը չի անցել ներկայացված բուն բողոքների քննարկմանը և չգիտի՝ դրանց մեջ խնդիր կա՞, թե՞ ոչ, հնարավոր չէ բավարարել դատախազության սույն բողոքը։

Վերաքննիչ դատարանը, լսելով կողմերին, հեռացել է խորհրդակցական սենյակ՝ որոշում կայացնելու։ Դատական ակտը կհրապարակվի այսօր՝ հուլիսի 15-ին, 15։30-ին։

Հիշեցնենք, որ Երևան քաղաքի ընդհանուր իրավասության դատարանը, նախագահությամբ Աննա Դանիբեկյանի, ապրիլի 6-ին, հիմք ընդունելով ՍԴ՝ Քր․ Օր․-ի 300․1 հոդվածը հակասահմանադրական ճանաչելու որոշումը, արդարացրել էր ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանին, նախկին փոխվարչապետ Արմեն Գևորգյանին, պաշտպանության նախկին նախարար Սեյրան Օհանյանին և ԶՈՒ ԳՇ նախկին պետ Յուրի Խաչատուրովին՝ դադարեցնելով նրանց նկատմամբ սույն հոդվածով քրեական հետապնդումը՝ հանցագործության դեպքի բացակայության հիմքով։
