Փաշինյանը հրաժարականից հետո չէր կարող պաշտոնավարել ԺՊ-ի կարգավիճակով. Դավիթ Հարությունյան

«Պատիվ ունեմ» դաշինքը շարունակում է պնդել՝  Նիկոլ Փաշինյանը վարչապետի պաշտոնակատարի կարգավիճակով չէր կարող շարունակել պաշտոնավարումը՝ վարչապետի պաշտոնից հրաժարականից հետո: «Արմենպրես»-ի հաղորդմամբ՝ Հարությունյանը նման տեսակետ հայտնեց Սահմանադրական դատարանում՝ ընտրությունների արդյունքների վիճարկման հարցով նիստին:

«Այն, որ վարչապետի կողմից հրաժարական ներկայացնելն էապես տարբերվում է ողջ կառավարության հրաժարական ներկայացնելուց, իմ կարծիքով, ակներև է: Բազմաթիվ են օրինակներն այլ երկրներում՝ հենց նույն մոդելի: Կարող է լինել 1-2 երկիր, երբ հակառակ մոդելն է, երբ վարչապետը հրաժարական է տալիս, սակայն շարունակում է իր պարտականությունները կատարել: Երկրների գերակշիռ մասը գնում է այլ ճանապարհով»,-ասաց Հարությունյանը:

Նա շեշտեց՝ երբ վարչապետը հրաժարական է տալիս, ապա լքում է այդ պաշտոնը՝ հավելելով, որ փոխվարչապետերի ինստիտուտը, շատ հաճախ, Սահմանադրությամբ ամրագրված է հենց այդ պատճառով:

Դավիթ Հարությունյանը նկարագրեց իրավիճակները, երբ վարչապետը հրաժարական է տալիս: «Երբ իր գործունեության ընթացքում երկիրը կրում է վիթխարի կորուստ կամ տեղի է ունենում մի այնպիսի երևույթ երկրում, որը խոսում է այն մասին, որ այդ անձն այլևս չի կարող ղեկավարել գործադիր իշխանությունը, ինքը հրաժարական է  տալիս: Այսինքն՝ հրաժարական տալու ինստիտուտը բառացի նույնն է նշանակում՝ ես հրաժարվեցի այս պաշտոնից»,-ասաց Հարությունյանն ու հավելեց, որ ԺՊ-ի կարգավիճակով պաշտոնավորումը շարունակելն այդ դեպքում Սահմանադրությամբ պաշտպանվող արժեք չէ:

Համեմատության համար նա խոսեց 3 դեպքերի մասին, որոնք կարգավորվում են Սահմանադրության 158-րդ հոդվածով, որը խոսում է Կառավարության հրաժարականի մասին. Կառավարությունը Հանրապետության նախագահին ներկայացնում է իր հրաժարականը նորընտիր Ազգային ժողովի առաջին նստաշրջանի, Կառավարությանը վստահություն չհայտնելու, Կառավարության ծրագրին հավանություն չտալու, վարչապետի կողմից հրաժարական ներկայացվելու կամ վարչապետի պաշտոնը թափուր մնալու օրը: Կառավարության անդամները շարունակում են իրենց պարտականությունների կատարումը մինչև նոր Կառավարության կազմավորումը:
