Ռազմագերիների հարցով ՀՀ-ից փաստաբանների խումբ պետք է գնա, որն այնտեղ կծանոթանա ստեղծված իրավիճակին. դա կարող է արվել բացառապես ռազմագերիների հարազատների ցանկության դեպքում. Հայկ Ալումյան

Ռազմագերիների հարցով ՀՀ-ից փաստաբանների խումբ պետք է գնա, որն այնտեղ կծանոթանա ստեղծված իրավիճակին և կփորձի պարզել՝ արդյո՞ք մեր ռազմագերիների նկատմամբ տեղի չեն ունենում Եվրոպական կոնվենցիայի խախտումներ: Այս մասին Tert.am-ի հետ զրույցում ասաց փաստաբան Հայկ Ալումյանը՝ անդրադառնալով Բաքվում 14 հայ ռազմագերիների գործով դատավարության գործընթացին:

«Այդուհետ, եթե այդպիսի խախտումներ տեղի են ունենում, ապա նրանց հետ քննարկել Եվրոպական դատարան դիմելու հարցը: Խոսքը չի վերաբերում Ադրբեջանի նեպետական դատարանններում մեր ռազմագերիների պաշտպանությանը, որովհետև Ադրբեջանի դատարանները այս իրավիճակում ակնհայտորեն չեն կարող  մեր ռազմագերիներին տրամադրել արդյունավետ պաշտանության միջոց: Այդ դատավարությունները, իմ տպավորությամբ, ուղղակի լեգիտիմության շղարշ են ստեղծում, այնինչ դատավճիռները հավանաբար վաղուց արդեն համաձայնեցված են»,-ասաց Ալումյանը:

Ըստ փաստաբանի՝ ՀՀ-ից գնացող փաստաբաններն Ադրբեջանում կարող են անարգել հանդիպել մեր քաղաքացիներին, որ պարզեն՝ Եվրոպական կոնվենցիայի խախտումներ նրանց նկատմամբ տեղի ունեցե՞լ են, այս ընթացքում տեղ ունենու՞մ են, և, եթե այդպիսի խախտումներ կան, ապա քննարկեն Եվրոպական դատարան դիմելու հարցը:

«Բացի այդ, շատ կարևոր է, որ մեր ռազմագերիներն այնտեղ տեսնեն ու հասկանան, որ իրենց հայրենիքն իրենց չի մոռացել, չի թողել ադրբեջանցիների քմահաճույքին, և իրավաբանները, որոնք իրենք կարող են վստահել, պատրաստ են պաշտպանել իրենց շահերը»,-ասաց նա:

Վերջինս ընդգծեց՝ թեև Ադրբեջանում ռազմագերիներից յուրաքանչյուրին տրամադրվել է փաստաբան՝ պետության հաշվին, բայց ակնհայտ է, որ եթե նունիսկ նա ամենաբարեխիղճ փաստաբանը լինի, միևնույն է, եթե պաշտպան-պաշտպանյալ հարաբերություններում չկա լիարժեք վստահություն, արդյունավետ պաշտպանություն չի կարող լինել:

«Հասկանալի է, որ ստեղծված իրավիճակում լիարժեք վստահություն չի կարող ձևավորվել պաշտպան-պաշտպանյալ հարաբերություններում: Եթե դրան էլ գումարենք, թե այնտեղ ինչ ընդհանուր մթնոլորտ է հայերի նկատմամբ, մենք հասկանում ենք, որ այնտեղի պաշտպանությունն ու դատարանները արդյունավետ միջոցներ չեն»,-ասաց նա:
