Արմեն Չարչյանի նկատմամբ իրականացվում է քաղաքական հետապնդում, գործ ունենք անթույլատրելի փաստական տվյալների հետ․ դատական ակտը միանշանակ բողոքարկելու ենք․ փաստաբան

Երևան քաղաքի ընդհանուր իրավասության դատարանը որոշում կայացրեց Արմեն Չարչյանին 1 ամսով կալանավորելու վերաբերյալ։ Դատարանը արձանագրել է ինչպես կալանավորման պայման հիմնավոր կասկածի առկայությունը, այնպես էլ կալանավորման հիմքերի, մասնավորապես՝ քննությանը խոչընդոտելու հիմքի համատեքստում գտել է, որ ռիսկը բարձր է։ Այս մասին Երևան քաղաքի ընդհանուր իրավասության դատարանի Ավանի նստավայրի բակում լրագրողների հետ զրույցում ասաց « Հայաստան» դաշինքի անդամ, «Իզմիրյլան» ԲԿ-ի տնօրեն Արմեն Չարչյանի փաստաբան Էրիկ Ալեքսանյանը։

Վերջինս նշեց, որ դատական ակտը միանշանակ բողոքարկելու են։

«Մենք գտնում ենք, որ դատարանի որոշումը ոչ իրավաչափ է, անհիմն որոշում է, փաստացի մեկ անգամ ընդգծվեց այն հանգամանքը, որ պարոն Չարչյանի նկատմամբ իրականացվում է բացառապես քաղաքական հետապնդում։ Մենք դա պնդել ենք դատական նիստի ժամանակ, ներկայացրել ենք բազմաթիվ փաստարկներ, որ այստեղ օրինական մեղադրանքի մասին չենք կարող խոսել, քանի որ ի սկզբանե քրեական վարույթը հարուցվել է ոչ իրավաչափ հիմուքների հիման վրա»։

Ալեքսանյանը ընդգծեց, որ քրեական գործ հարուցելու առիթ կարող է հանդիսանալ բացահայտված աղբյուրից ձեռք բերված տեղեկատվությունը։

«Քրեական գործ հարուցելու առիթ է հանդիսացել «Բաղրամյան 26» տելեգրամյան ալիքով հրապարակված տեսաձայնագրությունը։ Ձերբակալման իրավաչափությունը քննելու ժամանակ դատարանը շեշտը դրել է հենց նրա վրա, որ այդ ալիքի կողմից տարածված ձայնագրությունը անհայտ աղբյուրից տրամադրված ձայնագրություն է, ինչը հավասարազոր է անոնիմ (անանուն- խմբ.) հաղորդմանը։ Քրեական դատավարության տեսությունից բոլորս գիտենք, որ անոնիմ հաղորդումը երբեք որպես քրեական գործ հարուցելու առիթ չի կարող հանդիսանալ»։

Փաստաբանը շեշտեց, որ եթե գործ ունենք ոչ իրավաչափ վարույթի հետ, հետևաբար՝ այդ վարույթի շրջանակներում ձեռք բերված յուրաքանչյուր փաստական տվյալ անթույլատրելի է։

«Մենք գործ ունենք անթույլատրելի փաստական տվյալների հետ, ինչը իրավաբանությունից հեռու է։ Նման պայմաններում դատարանը չէր կարող հաստատել հիմնավոր կասկածի առկայությունը»։
