Ադրբեջանում միջազգային իրավունքի կոպիտ խախտումներով շարունակվում են հայկական կողմի գերիների նկատմամբ դատավարությունները․ ՄԻՊ

ՀՀ Մարդու իրավունքների պաշտպան Արման Թաթոյանը ֆեյսբուքյան իր էջում գրառում է արել՝ անդրադառնալով Բաքվում այսօր հայ գերիների մասնակցությամբ դատական նիստին։

Գրառումը ներկայացնում ենք ստորև․

«Այսօր՝ հունիսի 9-ին Բաքվում տեղի են ունեցել հայկական կողմի գերիներ Լյուդվիկ Մկրտչյանի և Ալյոշա Խոսրովյանի, իսկ հունիսի 8-ին` Վիգեն Էուլջեքյանի իրավունքները կոպիտ խախտող, միջազգային իրավունքը ոտնահարող քրեական գործերով հերթական դատական նիստերը:

Ադրբեջանական հրապարակումները վկայում են, որ հայկական կողմի գերիների նկատմամբ մեղադրանքներ են առաջադրվել, իբր, կկտտանքների, օրենքով չնախատեսված զինված կազմավորումներ կամ խմբեր ստեղծելու և այլ արարքների համար։

ՀՀ մարդու իրավունքների պաշտպանն արձանագրում է, որ նշված բոլոր անձինք գերեվարվել են արցախյան հակամարտության շրջանակներում և հակամարտությունը հիմա էլ չի ավարտվել: Ադրբեջանում պահվող հայկական կողմի բոլոր զինծառայողներն ու քաղաքացիական անձինք կարգավիճակով գերի են:

Հետևաբար, նրանցից որևէ մեկի նկատմամբ ցանկացած տեսակի հետապնդում կամ դատավարություն միջազգային իրավունքի կոպիտ խախտում է, նրանց կալանքի տակ պահելը` արգելված պատիժ: Այս կանոններն ուղղակիորեն բխում են միջազգային մարդասիրական իրավունքի պահանջներից:

Ավելին, ադրբեջանական իշխանությունները հայկական կողմի գերիների նկատմամբ քրեական հետապնդումներ են հարուցում հենց նրանց, այսպես կոչված, «խոստովանական ցուցմունքների» հիմքով, և դրանք օգտագործում` որպես ապացույց: Միջազգային իրավունքի այս կոպիտ խախտումներն ամրագրված են ՀՀ մարդու իրավունքների պաշտպանի հատուկ զեկույցում:

Ադրբեջանական իշխանությունների հայատյացության ու թշնամանքի քաղաքականությունն իր հերթին ևս հաստատում է քրեական ընթացակարգերի ոչ իրավաչափ լինելը և ավելորդ դարձնում մարդու որևէ իրավունքի երաշխավորման մասին խոսելը: Այս պայմաններում ակնհայտ վտանգված է գերիների կյանքի իրավունքը, խախտված են կենսական իրավունքները:

Ադրբեջանական իշխանությունները չեն հրապարակում գերիների իրական թիվը:

Մարդու իրավունքների պաշտպանի ուսումնասիրությունները, գերիների և անհայտ կորածների ծնողներից ստացվող բողոքները ակնհայտ վկայում են, որ նված դատավարությունները լրացուցիչ հոգեկան տառապանքներ են պատճառում նրանց ընտանիքներին և լարվածություն առաջացնում հայկական հասարակությունում: Ուստի, այդ դատավարություններն ամբողջությամբ հակասում են միջազգային իրավունքի հիմքերին և կոպտորեն խախտում են գերիների, նրանց ու անհայտ կորածների ընտանիքների իրավունքները, բացահայտ քաղաքականացնում են մարդասիրական հարցերը:
