ԵՊՀ–ի գիտական խորհուրդը կդիմի ՄԻՊ–ին

Երեւանի պետական համալսարանի գիտական խորհուրդը հայտարարություն է տարածել Կառավարության կողմից մայիսի 4-ին ընդունված` «ՀՀ կառավարության մի շարք որոշումներում փոփոխություններ եւ լրացումներ կատարելու մասին» որոշման վերաբերյալ եւ իր դիտողությունները հայտնել դրա հետ կապված։

Ամբողջական հայտարարությունը ստորև․

«Ղեկավարվելով «Երեւանի պետական համալսարան» հիմնադրամի կանոնադրության 49-րդ կետի 12-րդ եւ ԵՊՀ գիտական խորհրդի կանոնակարգի 4-րդ կետի 12-րդ ենթակետերով՝ Երեւանի պետական համալսարանի գիտական խորհուրդը, 2021 թ. մայիսի 6-ի արտահերթ նիստում քննարկելով ՀՀ կառավարության կողմից նույն թվականի մայիսի 4-ին ընդունված` «ՀՀ կառավարության մի շարք որոշումներում փոփոխություններ եւ լրացումներ կատարելու մասին» որոշումը՝ հիմնադրամի կարգավիճակ ունեցող պետական բուհերի կանոնադրություններում կառավարման խորհուրդների փոփոխությունների վերաբերյալ, արձանագրեց.

ա)  Մեր խորին համոզմամբ՝ որոշումը հակասահմանադրական է եւ հակաօրինական ինչպես բովանդակության, այնպես էլ ձեւի տեսանկյունից, քանի որ ուղղված է բացառապես մեկ ոչ իրավաչափ նպատակի՝ իշխանությունների կողմից անսահմանափակ վերահսկողություն սահմանել բուհերի, մասնավորապես եւ առաջին հերթին ԵՊՀ-ի նկատմամբ: Խորհուրդը որոշումը դիտարկում է որպես ԵՊՀ-ի դեմ վերջին տարիներին իշխանությունների կողմից տարվող հետեւողական եւ անթաքույց պայքարի հերթական դրսեւորում։

բ) Որոշման ընդունումը համարում ենք նաեւ բարոյական նորմերի կոպիտ խախտում՝ նկատի ունենալով այն, որ Սահմանադրական դատարանի վարույթում է հանրապետության նախագահի կողմից վիճարկվող «Բարձրագույն կրթության եւ գիտության մասին» օրենքի` բուհերի ինքնավարության  իրավակարգավորումների սահմանադրականության վերաբերյալ դիմումը: Այս պայմաններում ավելի նվազ իրավաբանական ուժ ունեցող իրավական ակտով` կառավարության որոշմամբ, օրենքի վիճարկվող դրույթները բուհերի համար էլ ավելի վատ պայմաններով կյանքի կոչելու նախաձեռնություն ակնհայտ արհամարհանք եւ անհարգալից վերաբերմունք է հանրապետության նախագահի, Սահմանադրական դատարանի եւ տվյալ օրենքի շահառու գիտակրթական ողջ հանրության նկատմամբ։

գ) Որոշման ընդունումն ուղեկցվել է իրավական եւ էթիկայի նորմերի կոպիտ խախտումներով. 2021 թ. ապրիլի 28-ին «e-draft.am» կայքում հրապարակելով նախագիծը եւ հանրային քննարկման ժամկետ սահմանելով մինչեւ մայիսի 14-ը՝ ՀՀ կառավարությունը մայիսի 4-ին գաղտնի, առանց նիստ հրավիրելու, գրավոր ընթացակարգով ընդունել է որոշում՝ փաստի առջեւ կանգնեցնելով բուհական ողջ համայնքին․ որոշման նախագիծը չի քննարկվել բուհերում, ավելին՝ այդ հաստատությունները նույնիսկ չեն տեղեկացվել իրենց իսկ կանոնադրություններում կատարվելիք փոփոխությունների մասին:
