«Մարտի 1–ի» գործի` Եվրադատարանի վճռին սպասելիս. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Առաջիկայում սպասվում է 2008 թ «Մարտի 1–ի» գործի առթիվ Մարդու իրավունքների Եվրոպական դատարանի վճռի հրապարակումը: Այս մասին «Փաստի» հետ զրույցում ասաց սպանվածների հարազատների շահերը պաշտպանող փաստաբան Արտակ Զեյնալյանը: Ըստ նրա՝ արդեն ավարտվել է ՄԻԵԴ–ՀՀ կառավարություն հարցուպատասխանի փուլը և այժմ սպասվում է վճիռը:

«Կառավարությունը գրեթե նույն պատասխաններն է տվել, ինչ տվել էր ներպետական վարույթում: Կարծում ենք՝ դրանք չունեն բավարար հիմքեր»,– «Փաստի» հետ զրույցում ասաց Զեյնալյանը:

Նշենք, որ չնայած անցել է 9 տարի, 2008 թ.–ի հետընտրական բողոքի ցույցերի ժամանակ 10 մարդու սպանության ու բազմաթիվ վիրավորների առթիվ որևէ մեկը չի դատապարտվել: ՀՀ կառավարությունը, ըստ իրեն ուղղված հարցերի, պետք է պարզաբաներ, թե արդյոք խախտվե՞լ է «Մարտի 1–ի» զոհերի՝ Եվրոպական կոնվենցիայի 2–րդ հոդվածով երաշխավորված կյանքի իրավունքը: Արդյոք նրանց մահը այնպիսի ուժի գործադրման հետևա՞նք է, որը եղել է «բացարձակ անհրաժեշտություն»: Արդյոք ներպետական ատյաններում քննությունն ընթացե՞լ է Կոնվենցիայի խախտումներով: Զոհերի իրավահաջորդների համար մինչ ՄԻԵԴ դիմելը սպառվա՞ծ են եղել երկրի ներսում արդյունավետ քննության հասնելու հնարավորությունները։

10 զոհերից 9–ի հարազատները դիմել էին ՄԻԵԴ՝ պահանջելով ճանաչել կյանքի, խոշտանգումներից ու անմարդկային վերաբերմունքից զերծ մնալու, արդյունավետ քննության, համարժեք փոխհատուցման և այլ իրավունքների խախտումները։

Խախտումը ճանաչելու դեպքում պետք է կրկին մահվան յուրաքանչյուր դեպքով քննություն իրականացվի՝ հանգամանքները պարզելու և մեղավորներին պատժելու համար: Մեխանիզմ կա նաև բարոյական և նյութական վնասի հատուցում տրամադրելու զոհվածների իրավահաջորդներին:

«Մարտի 1»–ի քրեական գործը Հայաստանում ոչ կարճված է, ոչ կասեցված: Պաշտոնապես հայտարարվում է, որ նախաքննությունը շարունակվում է։
