Արմեն Սմբատյանի պաշտպանների հայտարարությունը

Դեռևս նախորդ տարի, հոկտեմբերի 15-ին ՀՀ քննչական կոմիտեի Երևան քաղաքի վարչության քննիչի կողմից Իսրայելում Հայաստանի Հանրապետության դեսպան Արմեն Սմբատյանին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 38-308-րդ հոդվածի (պաշտոնեական լիազորությունները չարաշահելուն օժանդակելը) 2-րդ մասով և ՀՀ քրեական օրենսգրքի 190-րդ հոդվածի (հանցավոր ճանապարհով ստացված գույքն օրինականացնելը «փողերի լվացումը») 3-րդ մասի 1-ին կետով, այն ձևակերպմամբ, թե շուրջ 13 տարի առաջ վերջինս օժանդակել է պաշտոնատար անձի կողմից լիազորությունների չարաշահմանը, ինչը դրսևորվել է, ուշադրություն, այդ պաշտոնատար անձի գործողությունները չկանխելով, ապա օրինականացրել է իբր հանցավոր ճանապարհով ստացված գույք։ Փաստենք նաև, որ ինչպես առաջին ատյանի դատարանը, այնպես էլ ՀՀ Վերաքննիչ քրեական դատարանը արդեն հաստատել են այն պաշտոնատար անձին առաջադրված մեղադրանքի հիմնավոր կասկածի բացակայությունը, որին իբր անգործությամբ օժանդակել է դեսպան Արմեն Սմբատյանը։

Այս անհեթեթ մեղադրանքը կապված է Երևան քաղաքի Աբովյան 3 հասցեում գտնվող, «Արտասահմանյան երկրների հետ մշակութային համագործակցության հայկական» հասարակական կազմակերպության սեփականությունը հանդիսացած շենքի օտարման գործընթացի հետ։ Այդ գործընթացը, սակայն, հետապնդել է մեկ նպատակ` ներգրավել ներդրումներ վթարային վիճակում գտնվող, քանդման վտանգի առաջ կանգնած պատմամշակութային արժեք հանդիսացող շենքը հիմնանորոգելու ուղղությամբ, և դա իրականացնել այնպես, որ «Արտասահմանյան երկրների հետ մշակութային համագործակցության հայկական» հասարակական կազմակերպությունը հնարավորություն ունենա մշտապես իր գործունեությունը ծավալել այդ շենքում։ Արդյունքում, ներգրավված գումարներով շենքում իրականացվել են աննախադեպ հիմնանորոգման աշխատանքներ շենքի հիմքից սկսած, մինչև միջհարկային փայտյա բաժանարարների և տանիքի փոփոխում, ապա նաև կոսմետիկ վերանորոգում, ինչն իրականացվել է առանց շենքի պատմամշակութային արժեքին վնասելու։

Ընդ որում շենքի օտարման գործընթացը իրականացվել է բացառապես օրինական ու բաց գործարքների միջոցով, իսկ դեսպան Արմեն Սմբատյանը երբեք շենքի սեփականատեր ընկերության բաժնետեր չի հանդիսացել ու չի հանդիսանում, ուստի «ապօրինի» ծագում ունեցող գույքն օրինականացնելու մասով մեղադրանքը, կարծում ենք, առհասարակ մեկնաբանման կարիք չունի։

Ինչևէ փաստենք, որ վեց ամիս առաջ առաջադրված մեղադրանքի մասին այսօր Քննչական կոմիտեի կողմից տարածված հաղորդագրությունն ինքնին վկայում է այն մասին, որ հերթական անգամ գործ ունենք սանձազերծված ապօրինի հետապնդման հետ։ Ընդ որում, ամենևին պատահական չէ, որ այդ հաղորդագրությունը համընկել է դեսպան Արմեն Սմբատյանի կողմից աշխատանքից ազատման ցանկության մասին պետության ղեկավարությանը հայտնելու հանգամանքի հետ։
