Տեղի է ունենում դատական իշխանությանը բացահայտ ճնշելու գործընթաց. Արա Զոհրաբյան

Փաստաբանների պալատի նախագահ Արա Զոհրաբյանը ֆեյսբուքյան էջում գրել է. «ԲԴԽ ՆԱԽԱԳԱՀԻ ՀԱՐՑԸ

Առանց անձնավորելու ԲԴԽ շուրջ տեղի ունեցող իրադարձությունների մասնակիցներին, պետք է նշեմ, որ տեղի է ունենում դատական իշխանությանը բացահայտ ճնշելու գործընթաց:

Գործադիր իշխանությունը (վարչապետի դեմքով) և օրենսդիր իշխանությունը (իշխող ուժի պատգամավորների դեմքով) թիրախավորել են դատական իշխանությանը:
Ըստ հրապարակումների՝ «ԲԴԽ նախագահ Ռուբեն Վարդազարյանի դեմ հաղորդում է ներկայացրել նախկին դատավոր Անդրանիկ Սիմոնյանը, որը մի քանի օրով նշանակվեց Քննչական կոմիտեի նախագահի տեղակալ, ապա ԱԱԾ տնօրենի տեղակալ։ … Ու ահա Անդրանիկ Սիմոնյանը «հիշել է», թե Վարդազարյանը նախկինում իրեն զանգել է ու իր վարույթում գտնվող գործերից մեկով հանձնարարություններ տվել՝ ասելով- թե վիճահարույց գործ է, այնպես արա, որ պրոբլեմի մեջ չընկնենք։»:

Բարձրագույն դատական խորհուրդը 15.04.2021թ. որոշել է Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի դատավոր Ռուբեն Վարդազարյանի լիազորությունները կասեցնել՝ մինչև վերջինիս նկատմամբ հարուցված քրեական գործով վարույթի ավարտը: Նույն կերպ կասեցվել է Բարձրագույն դատական խորհրդի դատավոր անդամ (նախագահ) Ռուբեն Վարդազարյանի լիազորությունները:

Այս թեմայի մասով առկա է առնվազն 2 խնդիր, որը քրեական հետապնդում իրականացնող մարմինը պետք է գոնե իրավաբանական հանրույթին պարզաբանի.

  1. Արդյոք Ռուբեն Վարդազարյանի նկատմամբ հարուցված քրեական հետապնդումը իր լիազորությունների իրականացմանը չի առնչվում.
    ԲԴԽ որոշումից տեղեկանում ենք, որ Բարձրագույն դատական խորհրդի նախագահ Ռուբեն Վարդազարյանի նկատմամբ քրեական հետապնդումը հարուցվել է ՈՉ ԻՐ լիազորությունների իրականացման կապակցությամբ:
    ԶԼՄ հրապարակումներից տեղեկանում ենք, որ ըստ հաղորդման՝ Ռ.Վարդազարյանը զանգել է դատավորին ասելով- թե վիճահարույց գործ է, այնպես արա, որ պրոբլեմի մեջ չընկնենք:

Այստեղից կարող ենք հետևություն անել, որ Ռ.Վարդազարյանի ենթադրյալ զանգը ուղղված դատավորին քրեական հետապնդման մարմնի կողմից կարևորվել է հաշվի առնելով Ռ. Վարդազարյանի՝ ԲԴԽ նախագահի պաշտոնեական դիրքը (բնական է, որ այս փաստը դեռ պետք է ապացուցվի):
Հիմա հարց, եթե ԲԴԽ նախագահը իր պաշտոնեական դիրքով է դատարանի գործունեությանը միջամտել, իսկ ԲԴԽ նախագահը զուգահեռ նաև դատավոր է, ապա ինչպես կարող է քրեական հետապնդման մարմինը պնդել, որ Վարդազարյանի ենթադրյալ գործողությունը կապված չէ իր լիազորությունների իրականացման հետ: Բարձրագույն դատական խորհուրդն այս տրամաբանությունն ու փաստն ընդունել է իր 15.04.2021թ. որոշման 2-րդ կետով, երբ դատավորի լիազորությունների կասեցման ուժով կասեցրել է նաև ԲԴԽ նախագահի լիազորությունները:
ՀՀ Սահմանադրության 164-րդ հոդվածի 4-րդ մասի համաձայն՝ իր լիազորությունների իրականացման կապակցությամբ դատավորի նկատմամբ քրեական հետապնդում կարող է հարուցվել միայն Բարձրագույն դատական խորհրդի համաձայնությամբ:
Այս նորմի ուժով ԲԴԽ նախագահ Ռուբեն Վարդազարյանի նկատմամբ չէր կարող քրեական հետապնդում իրականացվել առանց ԲԴԽ համաձայնության: Մինչդեռ ԲԴԽ-ն այդպիսի համաձայնություն չի տվել: Առանց այդ համաձայնության քրեական հետապնդում չէր կարող իրականացվել:
