Ըստ ՀՀ ոստիկանության ներքին անվտանգության վարչության՝ մարդուն «հավայի տեղը» ձերբակալելն ուղղակի կարգապահական խախտում է, ոչ ավելին. Պաշտպան

Այսօր ստացա ՀՀ ոստիկանության ներքին անվտանգության վարչության պետի տեղակալ Վ.Հարությունյանի գրությունը:

Այն վերաբերվում է իմ կողմից ՀՀ ոստիկանության պետին հասցեագրված գրությանը՝ ոստիկանության Արաբկիրի բաժնի պետ Ա.Վաթյանի կողմից իմ պաշտպանյալ Հակոբ Հովհաննիսյանին ապօրինի ձերբակալելու վերաբերյալ:

Վերը նշված գրությամբ ներքին անվտանգության վարչության պետի տեղակալը հայտնում է, որ իրականացված ծառայողական քննության արդյունքում պարզվել է, որ Արաբկիրի բաժնի պետ Ա.Վաթյանը, առանց սահմանված հիմքերի, նպատակների և նույնիսկ առանց ձերբակալման արձանագրությունը պաշտպանյալիս ծանոթացնելու ձերբակալելով իմ պաշտպանյալին, չի պահպանել ՀՀ օրենքների և իրավական ակտերի պահանջները և թույլ է տվել կարգապահական խախտում:

Այսինքն, ըստ ՀՀ ոստիկանության ներքին անվտանգության վարչության՝ մարդուն «հավայի տեղը» ձերբակալելն ուղղակի կարգապահական խախտում է, ոչ ավելին:

Սակայն սա դեռ ամենը չէ. հարգարժան ներքին անվտանգության վարչության պետի տեղակալը հայտնել է նաև, որ ոստիկանության գնդապետ Ա.Վաթյանը ենթակա է կարգապահական պատասխանատվության, սակայն ղեկավարվելով «ՀՀ ոստիկանության կարգապահական կանոնագիրքը հաստատելու մասին» ՀՀ օրենքի 16-րդ հոդվածի 1-ին մասով, նրա նկատմամբ կարգապահական տույժ չի կիրառվել:

Նշեմ, որ համաձայն այդ կանոնագրքի 16-րդ հոդվածի 1-ին մասի՝ «Ծառայողական քննություն նշանակող անձի որոշմամբ կարգապահական խախտում կատարած ոստիկանության ծառայողը կարող է ազատվել կարգապահական տույժից, եթե նման արարք կատարել է առաջին անգամ, կամ կարգապահական խախտում կատարած ոստիկանության ծառայողն անկեղծորեն զղջացել է, ներողություն է խնդրել կոլեկտիվից կամ տուժողից կամ կամավոր հատուցել է իրավախախտմամբ պատճառված վնասը»:
