Նախադեպն ավելի վտանգավոր է դառնում, երբ հայկական կողմն է հաշտվում իրավիճակի հետ՝ սահմանների որոշակիացման, ճանապարհների բացման և համատեղ օգտագործման գործողություններով. Տարոն Սիմոնյան

Պետություններն ու միջազգային կազմակերպությունները մի կողմից ընդունում են, որ Ադրբեջանը կատարել և կատարում է միջազգային իրավունքի կոպիտ խախտումներ, մյուս կողմից վերջինիս նկատմամբ ոչ մի հետևանք չեն առաջացնում։ Այս մասին ֆեյսբուքյան իր էջում գրառում է կատարել «Լուսավոր Հայաստան» խմբակցության անդամ Տարոն Սիմոնյանը՝ արձանագրելով, որ նախադեպը շատ ավելի վտանգավոր է դառնում, երբ հիմնական տուժողը՝ հայկական կողմը՝ ինքն է հաշտվում այս իրավիճակի հետ՝ սահմանների որոշակիացման, ճանապարհների բացման և համատեղ օգտագործման, իրավաչափ պահանջներից հրաժարման և այլ գործողություններով։

«Ադրբեջանաթուրքական կողմից միջազգային իրավունքի կոպիտ խախտումները (ագրեսիա, պատերազմական, մարդկության դեմ ուղղված հանցագործություններ՝ էթնիկ զտումներ, խոշտանգումներ, վարձկանների օգտագործում, ահաբեկչություն և այլն) տարածաշրջանում և ընդհանրապես՝ միջազգային հարթակում ստեղծել են լրիվ նոր իրավիճակ։

Մի կողմից խնդրով հետաքրքրված գրեթե բոլոր պետություններն ու միջազգային կազմակերպություններն ընդունում են, որ Ադրբեջանը կատարել և կատարում է միջազգային իրավունքի կոպիտ խախտումներ, մյուս կողմից վերջինիս նկատմամբ ոչ մի հետևանք չեն առաջացնում։ Ավելին, խոսում են «մոռանալու, հաշտվելու և տարածաշրջանում նոր բարեկամական կյանք սկսելու» մասին։

Սա վտանգավոր նախադեպ է, քանի որ ուղղակիորեն հակասում է միջազգային իրավակարգի էությանն ու անգամ՝ դրա գոյությանը։

Միջազգային իրավունքում գոյություն ունի ex injuria jus non oritur սկզբունքը, համաձայն որի անօրինական գործողություններն իրավունք չեն ստեղծում։

Հետևաբար, եթե Արցախյան խնդրի լուծմանը ներգրավված կամ դրա լուծմամբ շահագրգրված պետություններն ու կազմակերպությունները փաստում են, որ այսօրվա իրավիճակը ստեղծվել է միջազգային իրավունքի կոպիտ խախտումների արդյունքում, ապա չպետք է ընդունեն այն որպես իրավաչափ, օրինական կամ այլ կերպ ընդունելի։

Նախադեպը շատ ավելի վտանգավոր է դառնում, երբ հիմնական տուժողը՝ հայկական կողմը՝ ինքն է հաշտվում այս իրավիճակի հետ՝ սահմանների որոշակիացման, ճանապարհների բացման և համատեղ օգտագործման, իրավաչափ պահանջներից հրաժարման և այլ գործողություններով։

Պատերազմի ակտիվ փուլի ավարտից հետո՝ ամեն օր, հայկական երկու պետությունները պետք է ամբողջ աշխարհին ներկայացնեն ադրբեջանաթուրքական հանցագործությունները՝ որպես սպառնալիք միջազգային անվտանգությանը, քանի որ այս «լուռ համաձայնության վտանգավոր նախադեպը», որ այսօր զարգացվում է, ի վիճակի է քանդելու առանց այն էլ փխրում միջազգային ամբողջ իրավակարգը։

Սա չանելը կամ գործողություններով այլ կերպ այս նախադեպին նպաստելը հավասարազոր է համաձայնելու և արդարացնելու ադրբեջանաթուրքական կողմի ագրեսիան, պատերազմական և մարդկության դեմ ուղղված հանցագործությունները»,- գրել է Սիմոնյանը։
