Եթե օրենք գրել չգիտեք, ամոթ չի՝ խնդրեք Լուսավորին, կօգնեն, երկրին է պետք

Նիկոլ Փաշինյանը գերազանցել է օրենսդրական աճպարարություններ իրականացնելու բոլոր հնարավոր ռեկորդները: Իր և իր թիմի քաղաքական ամբիցիաներն ու նախասիրությունները բավարարելու համար նա ընդունակ է «ուսապարկերի խմբակցությանը» այնպիսի օրենսդրական փոփոխություններ իրականացնելու հրահանգ իջեցնել, որոնց հետևանքով պետական կամ քաղաքական ինստիտուտներ կարող են փլուզվել: Եթե պետք լինի, Նիկոլը, դիցուք, Վահագն Հովակիմյանին կարող է հանձնարարել օրենքի նախագիծ մշակել ըստ որի՝ Յուպիտեր մոլորակը կհայտարարվի Հայաստանի անկլավ: Ինչևէ, իշխանությունները արտահերթ ընտրություններին ընդառաջ «Ընտրական օրենսգրքում» նախաձեռնել են հերթական «ժողովրդավարական բարեփոխումները»:

Զարմանալի չէ նաև այն, որ դրա մասին առաջինը ահազանգում է Լուսավոր Հայաստան կուսակցությունը, որն իր պառլամենտական գործունեության ընթացքում երբեք չի «կաղացել» նմանատիպ խութեր տեսնելու և դրանց դեմ պայքարելու գործում: Ազնիվ լինելու համար պետք է արձանագրել, որ ԼՀԿ պատգամավորներն այդ գործում կարողանում են պրոֆեսիոնալ մոտեցումներ առաջ քաշել: Այսպիսով, ի՞նչ են ուզում անել Նիկոլ Փաշինյանի օրենսդիրները:

Գործող Ընտրական օրենսգիրքը հնարավորություն է տալիս անցողիկ շեմը հաղթահարած բոլոր ուժերին 6-օրյա ժամկետում բանակցելու և խորհրդարանական կոալիցիա ձևավորելու համար։ Ըստ որում, եթե նոր կոալիցիա չի ձևավորվում, ապա երկրորդ փուլ անցած ուժերը կարող են մասնակցել նոր դաշինքով՝ միավորվելով անցողիկ շեմը հաղթահարած ուժերի հետ։ Առաջարկվող նոր Ընտրական Օրենսգիրքը սահմանափակում է երկու հնարավորությունն էլ։ Նախ կոալիցիա կազմելու հնարավորության համար տրվում է 14 օր ժամանակ, սակայն այդ հնարավորությունից կարող է օգտվել միայն առաջին տեղը զբաղեցրած ուժը և, ըստ էության, մյուս ուժերը այդ ընթացքում բանակցություններ վարելու իրավունք չունեն։ Ապա 7-օրյա ժամկետ է տրվում մյուս ուժերին։

Ի՞նչ է ստացվում՝ առաջին տեղը զբաղեցնող ուժին տրվում է արհեստական առավելություն։ Այսինքն Նիկոլ Փաշինյանը կարծում է, որ այդուհանդերձ իր ղեկավարած ուժը եթե նույնիսկ բացարձակ մեծամասնություն չկազմի, ապա գոնե ամենաշատ ձայներ հավաքածը կլինի: Եվ եթե առաջին տարբերակով չկարողանա իշխանությունը վերցնել, ապա մյուս ուժերին օրենքով կզրկի միավորվելու և իշխանություն ձևավորելու հնարավորությունից: Բացի այդ, վերացվում է երկրորդ փուլում նոր դաշինք ձևավորելու հնարավորությունը, որը այս իրավիճակում բխում է միայն գործող իշխանությունների շահերից։ Սա խայտառակ մոտեցում է և եթե այնուամենայնիվ այդ տեսքով այն ընդունվի, ապա, համամիտ եմ Լուսավոր Հայաստանի մոտեցման հետ՝ խորհրդարանական ընդդիմությունը պետք է այն վիճարկի Սահմանադրական դատարանում, իսկ մինչ այդ քաղաքական ճնշմամբ փորձի խոչընդոտել գործը ՍԴ հասնելուն:
