«Իրատես». PhilipMorris-ը դատարանում պարտվել է հայկական «Ararat»-ին

2017 թ. մարտի 22-ին Մոսկվայի արբիտրաժային դատարանը վերջապես վերջնական վճիռ կայացրեց «Marlboro»-ն ընդդեմ «Ararat»-ի գործով: Դատարանը լիովին մերժեց «PhilipMorris BrandsSarl» ընկերության հայցն ընդդեմ «Грант табак» ԲԲԸ-ի (ՌԴ-ում «Ararat» սիգարետների ներմուծողի): Դա նշանակում է, որ, դատարանի կարծիքով, չկա «Marlboro» սիգարետների դիզայնի հետ «Ararat» սիգարետների դիզայնը շփոթելու աստիճանի նմանություն: Իսկ դա էլ իր հերթին նշանակում է, որ վաճառակետերը կարող են այսուհետ ևս անարգել վաճառել «Ararat» սիգարետները ՌԴ տարածքում: Սա հայ արտադրողի հերթական հաղթանակն է: Այս մասին գրել է «Իրատես»-ը:
Թերթի փոխանցմամբ, «Marlboro»-ի «ռուֆտոպ» տարրի ինքնատիպության և «Marlboro» ապրանքանիշին նմանության պատրանք ստեղծելու «Ararat» սիգարետի արտադրողի մտադրության մասին «PhilipMorris BrandsSarl»-ի պնդումները դատարանը համարել է անհիմն: «Ararat» սիգարետի տուփերի վրայի պատկերային տարրը իրենից ներկայացնում է հայ ժողովրդի սրբազան լեռան ոճավոր պատկերը և միասնական իմաստային կառուցվածք է կազմում «Ararat» բառային տարրի հետ:
«Դատարանը նշել է նաև, որ 23.02.2013 թ. «Շրջակա ծխախոտի ծխի ազդեցությունից և ծխախոտի օգտագործման հետևանքներից քաղաքացիների առողջության պաշտպանության մասին» դաշնային օրենքի 19-րդ հոդվածին համապատասխան, գնորդը սիգարետ գնելիս չի կարող տեսնել սիգարետի փաթեթը և, հետևաբար, սիգարետների տուփի վրայի պատկերը: Նա սիգարետը պետք է ընտրի բացառապես ըստ խանութի ներկայացրած ցուցակում նշված անվանման: «GrandTobacco» ընկերության իրավաբան Նիկոլայ Հակոբյանը կարծում է, որ «PhilipMorris BrandsSarl»-ը փորձել է արհեստական խոչընդոտներ հարուցել, նպատակ ունենալով արգելել հայկական սիգարետների շրջանառությունը ռուսական շուկայում: Հակոբյանի խոսքերով ասած, դրա պատճառն այն է, որ, ինչպես դատարանում նշեց «PhilipMorris BrandsSarl»-ի ներկայացուցիչը, որքան շատ են վաճառվում «Ararat»-ի սիգարետները, այնքան քիչ են վաճառվում «Marlboro»-ինը: «PhilipMorris BrandsSarl»-ը ձգտում էր դա ներկայացնել որպես վնաս իր ընկերության համար: Այսպիսով, այս դատավճիռը մեկ անգամ ևս ապացուցեց, որ արտադրողն իրավունք ունի բարեխիղճ մրցակցության պայմաններում իր տեղն ունենալու ռուսական շուկայում»,-հավելել է թերթը:
