Անտառապահին և Տավուշի մարզի 6 բնակչի մեղադրանք է առաջադրվել. գործը դատարանում է

ՀՀ քննչական կոմիտեի Տավուշի մարզային քննչական վարչությունում ավարտվել է Տավուշի մարզի բնակիչների կողմից ծառերի ապօրինի հատման և դրանք առանց թույլտվության տեղափոխելու դիմաց «Հայանտառ» ՊՈԱ կազմակերպության  անտառապահին 5մլն.790 հազար դրամ կաշառք տալու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը: Այս մասին տեղեկացրին ՀՀ քննչական կոմիտեից։

Քրեական գործի տվյալներով՝ «Հայանտառ» պետական ոչ առևտրային կազմակերպության անտառապահը, անձնական շահագրգռվածությունց ելնելով, ծառայության նկատմամբ անբարեխիղճ և անփույթ վերաբերմունք դրսևորելով, Տավուշի մարզի բնակիչներին թույլատրել է տարբեր պահաբաժիններում իրականացնել ապօրինի ծառահատումներ, որի հետևանքով պետությանը պատճառվել է առանձնապես խոշոր չափերի վնաս:

Կատարված բազմակողմանի քննությամբ պարզվել է, որ 2015-2018թթ. ընթացքում ապօրինի հատվել է ընդհանուր 102 հատ տարբեր տեսակի և տրամագծի ծառ, որի հետևանքով պետությանը պատճառվել է 10 117 500 ՀՀ դրամի վնաս։

Քրեական գործի նախաքննությամբ պարզվել և հիմնավորվել է, որ «Հայանտառ» ՊՈԱ կազմակերպության «Իջևանի անտառտնտեսություն» մասնաճյուղի «Խաչարձանի»  անտառպետության թիվ 1 պահաբաժնի անտառապահը պատշաճ չի կատարել իր վրա դրված պարտականությունները, այն է՝ չի իրականացրել կանխարգելիչ միջոցառումներ և հսկողություն՝ ապօրինի անտառհատումների և ՀՀ անտառային օրենսդրության այլ խախտումների նկատմամբ, իսկ անհրաժեշտության դեպքում չի կազմել համապատասխան անտառխախտման արձանագրություններ և չի ներկայացրել անտառապետին, չի ստուգել բնափայտի մթերման և այլ տեսակի անտառօգտագործման իրավունք ընձեռող փաստաթղթերը և հսկողություն չի սահմանել անտառօգտագործողների կողմից դրանց կատարման նկատմամբ։

Քննությամբ փաստական տվյալներ են ձեռք բերվել այն մասին, որ անտառապահը Տավուշի մարզի վեց բնակիչների  թույլատրել է իր պահպանության տակ գտնվող պահաբաժնի անտառամասերում կատարել ապօրինի ծառահատումներ, փայտանյութի ապօրինի պատրաստում ու անտառից տեղափոխում և նրանց կողմից իր թույլտվությամբ արդեն կատարված այդ իրավախախտումները իր կողմից օրինական ընթացակարգով չարձանագրելու, որպես պաշտոնատար անձ իր պաշտոնեական լիազորությունները չկատարելու դիմաց նրանցից պահանջել և մաս-մաս անձամբ ստացել է տարբեր չափերի, ընդհանուր առմամբ 5մլն.790 հազար դրամ, կաշառք, ինչի շուրջ նախօրոք ձեռք են բերվել պայմանավորվածություններ:

Նշված անձանց կողմից անտառ գնալու, ծառահատումների և փայտանյութի ապօրինի պատրաստման և տեղափոխման մասին տեղեկացված լինելով՝ անտառապահը նրանց նախապես տեղեկացրել է՝ անտառում ստուգում իրականացնողների առկայության մասին՝ արգելելով նրանց գնալ անտառ, երբեմն նրանցից պահանջել է թաքցնել անատառահատման մասին վկայող հետքերը, նրանց է տվել իր մոտ եղած կնքամուրճը՝ վերջիններիս կողմից հատված ծառերի կոճղերը կնքելու համար։

Ձեռք բերված բավարար ապացույցների հիման վրա՝ անտառապահին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի (կաշառք ստանալը) 1-ին մասով, 311-րդ հոդվածի 3-րդ մասի 3-րդ կետով (4 դրվագ), ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 4-րդ մասի 2-րդ կետով (2 դրվագ), իսկ Տավուշի մարզի վեց բնակիչներին՝ ծառերի ապօրինի հատման, դրանք առանց թույլտվության տեղափոխելու և տարբեր չափերի կաշառք տալու համար: Քրեական գործով բոլոր մեղադրյալների նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն՝ չհեռանալու մասին:

Նախաքննությունն ավարտվել է, և քրեական գործը, մեղադրական եզրակացությամբ, ուղարկվել է դատարան:
