Եղբայրն արդուկով հարվածներ է հասցրել քրոջ գլխին, կոտրել ձեռքը, սպառնացել մկրատով հանել աչքերը․ գործը դատարան է հասել

ՀՀ քննչական կոմիտեի Կոտայքի մարզային քննչական վարչությունում ավարտվել է եղբոր կողմից առանձին դաժանությամբ, դիտավորությամբ քրոջ առողջությանը ծանր վնաս պատճառելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը:

Իրականացված քննչական և այլ դատավարական գործողությունների արդյունքում պարզվել են դեպքի հանգամանքները, շարժառիթը:

Քննությամբ ապացույցներ են ձեռք բերվել այն մասին, որ Երևան քաղաքի բնակիչ, 1969թ. ծնված տղամարդը տարբեր պատճառներով բազմիցս բռնություն է գործադրել քրոջ նկատմամբ, գումարային հարցերի շուրջ տարաձայնություններ է ունեցել նրա հետ, ինչն էլ պատճառ է հանդիսացել նրանց միջև ժամանակ առ ժամանակ ծագող վիճաբանությունների:

Մասնավորապես՝ պարզվել է, որ տղամարդը 38.000 ԱՄՆ դոլարով վաճառել է Երևան քաղաքում գտնվող, սեփականության իրավունքով իրեն և քրոջը պատկանող հայրական տունը: Ստացված գումարից 35.000 ԱՄՆ դոլարը եղբայրը փոխանցել է քրոջ անվամբ բացված բանկային հաշվեհամարին, որից վերջինս եղբորը մաս-մաս առձեռն տվել է 25.000 ԱՄՆ դոլար գումար և թույլ տվել եղբորը, որպեսզի վերջինս Կոտայքի մարզի Թեղենիք գյուղում գտնվող և իրեն պատկանող հողամասի վրա, իր տան հարևանությամբ, տուն կառուցի պայմանով, որ նա փոխվելու է, ալկոհոլ չի օգտագործելու և ապրելու է նորմալ կյանքով:

Սակայն որոշ ժամանակ անց եղբայրը քրոջից սկսել է պահանջել իրեն տալ տան առքուվաճառքից մնացած 10.000 ԱՄՆ դոլար գումարը և Թեղենիքում գտնվող, նույն հողամասում գտնվող և քրոջը պատկանող տունը, ինչը վերջինիս կողմից մերժվել է, որն էլ նրանց միջև տևական ժամանակ դարձել է տարաձայնության պատճառ:

Դեպքի օրը՝ 2020թ. հոկտեմբերի 1-ին, գտնվելով լարված փոխհարաբերությունների մեջ, ժամը 00:20-ի սահմաններում եղբայրն այցելել է քրոջը և պահանջել խնդրո առարկա 10.000 ԱՄՆ դոլարը:

Կրկին անգամ մերժում ստանալով՝ վիճաբանել է քրոջ հետ, որի ընթացքում տանջելու, խոշտանգելու միջոցով, առանձին դաժանությամբ մարմնական վնասվածքներ պատճառելու դիտավորությամբ, արդուկով հարվածներ է հասցրել քրոջ գլխին, նույն արդուկով հարվածելով կոտրել է ձեռքը, ինչի արդյունքում վերջինս վայր է ընկել, իսկ եղբայրը սեղմել է նրա կոտրված ձեռքը, ապա՝ սպառնացել մկրատով հանել աչքերը և կտրել ականջները, այնուհետև տևական ժամանակ ոտքերով և ձեռքերով բազմաթիվ հարվածներ է հասցրել քրոջ մարմնի տարբեր մասերին՝ այդ կերպ առանձին դաժանությամբ վերջինիս առողջությանը պատճառելով կյանքին վտանգ սպառնացող ծանր վնաս:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ 51-ամյա տղամարդուն մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 112-րդ հոդվածի (դիտավորությամբ առողջությանը ծանր վնաս պատճառելը) 2-րդ մասի 4-րդ կետով: Նրա նկատմամբ որպես խափանման միջոց է կիրառվել չհեռանալու մասին ստորագրությունը:

Նախաքննությունն ավարտվել է, և քրեական գործը, մեղադրական եզրակացությամբ, ուղարկվել է դատարան:
