Ոստիկանները դիմում են բոլոր քաղաքացիներին. հայտարարություն

Ոստիկանությունը հայտարարություն է տարածել՝ հավաքի մասնակիցներին հորդորելով․ – իրենց գործողություններում խստորեն պահպանել օրենսդրության պահանջները,

– չխոչընդոտել հավաքի անցկացման վայրում գտնվող կամ դրան հարող շենքեր, այդ թվում՝ պետական մարմինների շենքեր և շինություններ կամ այլ տարածքներ քաղաքացիների և պետական ծառայողների ազատ մուտքն ու ելքը,

– թույլ չտալ այլ քաղաքացիների ազատ տեղաշարժման իրավունքի, ինչպես նաև տրանսպորտային միջոցների երթևեկության անհամաչափ սահմանափակումներ,

– զերծ մնալ պատմության և մշակույթի անշարժ հուշարձանների տարածքները, նաև Հանրապետության Հրապարակի համալիրն առանց իրավասու մարմինների թույլտվության օրենքով չնախատեսված այլ նպատակներով օգտագործելուց, այդ թվում՝ վրաններ տեղադրելու եղանակով։

Այս համատեքստում Ոստիկանությունը հիշեցնում է, որ «Պատմության և մշակույթի անշարժ հուշարձանների ու պատմական միջավայրի պահպանության և օգտագործման մասին» ՀՀ օրենքի 38-րդ հոդվածի ուժով հուշարձանները գերազանցապես օգտագործվում են գիտական, կրթական, մշակութային և ճանաչողական նպատակներով, ինչպես նաև իրենց սկզբնական ու հարմարեցված (ադապտացիոն) գործառնական նշանակությամբ։ Օրենքը նաև սահմանում է, որ հուշարձանների օգտագործումը տնտեսական և այլ նպատակներով թույլատրվում է, եթե այդպիսի օգտագործումը համապատասխանում է հուշարձանի բնույթին, չի վնասում հուշարձանի անվթարությունը, չի նսեմացնում կամ աղճատում դրա պատմական, գիտական և գեղարվեստական արժեքը։  

Այսպիսով, Ոստիկանությունը հավաքի անցկացման նպատակով վրանների տեղադրումը պատմության և մշակութային հուշարձաններին հարող տարածքներում և դրանց օգտագործումը դիտարկում է անհամատեղելի այդ վայրի պատմական և մշակութային նշանակության հետ և դրա գեղարվեստական արժեքը նսեմացնող, քանի դեռ առկա չէ իրավասու պետական մարմնի համաձայնությունը՝ կոնկրետ հավաքի անցկացման համար վրանների տեղադրման կամ այլ առարկաների օգտագործման վերաբերյալ։
