Այս օրինագծերի փաթեթը հակասում է Սահմանադրությանը, բուհերն ինքնակառավարման իրավունք ունեն․ ԵՊՀ պրոֆեսոր

Առաջին հայացքից էլ պարզ է, որ օրինագծերի փաթեթը միտված է ոչ թե գիտության եւ կրթության ոլորտներում բարեփոխումներ անելուն, այլ այն որոշակի քաղաքական կոնտենտ ունեցող գործընթացի մաս է։ Այս մասին այսօր՝ դեկտեմբերի 3-ին հրավիրված ասուլիսում ասաց ԵՊՀ ռեկտորի թեկնածու, ԵՊՀ իրավագիտության ֆակուլտետի քաղաքացիական դատավարության ամբիոնի վարիչ Վահե Հովհաննիսյանը՝ անդրադառնալով «Բարձրագույն կրթության եւ գիտության մասին» ու հարակից օրենքների նախագծերի փաթեթին, որն այսօր Կառավարության կողմից հավանության է արժանացել։

Օրինագծերի փաթեթը սահմանում է, որ բուհերի ռեկտորները եւ գիտական հաստատությունների տնօրենները ոչ թե ընտրվելու են, այլ նշանակվելու են անմիջապես ԿԳՄՍ նախարարության կողմից մինչեւ 5 տարի ժամկետով։

Վահե Հովհաննիսյանի ներկայացմամբ՝ այս օրինագծերի փաթեթը հակասում է Հայաստանի Սահմանադրությանը, ընդ որում ոչ միայն Սահմանադրության 38-րդ հոդվածի 3-րդ կետին, որով ահմանում է, որ բարձրագույն ուսումնական հաստատություններն օրենքով սահմանված շրջանակներում ունեն ինքնակառավարման իրավունք, ներառյալ ակադեմիական եւ հետազոտությունների ազատությունը, այլեւ  Քաղաքացիական օրենսգրքին եւ Հիմնադրամների մասին օրենքին, որոնցով հնարավորություն չի ընձեռվում, որպեսզի Կառավարությունը անմիջականորեն նշանակի բուհի ռեկտոր՝ մինչեւ 5 տարի ժամկետով։

«Այստեղ այլ ռիսկեր էլ են թաքնված։ Խոսքն այն մասին է, որ ժամանակավոր կառավարիչը, փաստորեն, շատ ավելի երաշխավորված է լինելու իր գործունեության մեջ, շատ ավելի լայն հայեցողությամբ, քան բուհի ռեկտորը, որը կաշկանդված է լինելու բուհի զարգացման ռազմավարության ծրագրով։ Կառավարչի նկատմամբ չեն տարածվելու բուհի ռեկտորների համար սահմանված օրենսդրական պահանջները։ Ընդ որում՝ հանված է նաեւ այն դրույթը, որ եթե կառավարման կամ հոգաբարձուների խորհուրդը չհաստատի հաշվետվությունը, ապա տվյալ անձը չի կարող պաշտոնավարել»,- ասաց Վահե Հովհաննիսյանը։

Իրավաբանական գիտությունների դոկտորի, պրոֆեսորի դիտարկմամբ՝ այս օրինագծերի փաթեթով ակադեմիական ազատությունը չի երեշխավորվելու։

«Հետեւաբար հայագիտական առարկաները  ոչ պարտադիր համարելը կամ պարտադիր համարելու պարագայում այն ակադեմիական ազատությանը հակադրելը, կեղծ օրակարգ է։ Հաշվի առնելով սա՝ կոչ եմ անում ԱԺ իրավաբան գործընկերներիս առաջին հերթին չդավաճանեն իրենց մասնագիտությանը, եւ օրենքով սահմանված միջոցներով պայքարել այս օրինագծերի փաթեթի գործողությունները բացառելու համար»,- նշեց Վահե Հովհաննիսյանը։

ԵՊՀ իրավագիտության ֆակուլտետի քաղաքացիական դատավարության ամբիոնի վարիչը հայտարարեց, եթե  անհրաժեշտ լինի անգամ պատրաստ են գործադուլի կամ դասադուլի դիմել։
