Հորը և որդուն մեղադրանք է առաջադրվել՝ ոստիկանության աշխատակիցների նկատմամբ բռնություն գործադրելու համար

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Քանաքեռ-Զեյթուն վարչական շրջանի քննչական բաժնում քննվող քրեական գործով իրականացված  մեծածավալ  քննչական  և դատավարական գործողությունների արդյունքում պարզվել է իշխանության ներկայացուցիչ հանդիսացող ոստիկանության աշխատակիցների նկատմամբ բռնություն գործադրելու դեպքի բոլոր հանգամանքները, տեղեկացնում է ՀՀ քննչական կոմիտեի տեղեկատվության և հասարակայնության հետ կապերի բաժին:

Քննությամբ ձեռք բերված տվյալների համաձայն՝ 2020 թ. ապրիլի 27-ին՝ ժամը 15:30-ին, Երևան քաղաքի Քանաքեռ 6-րդ փողոցից ստացված ահազանգով մեկնած մի խումբ ոստիկաններ հասնելով դեպքի վայր, նրանց  «Օպել» մակնիշի ավտոմեքենայով ընդառաջ է դուրս եկել 25-ամյա երիտասարդ, որը, անհարգալից վերաբերմունք  դրսևորելով,  անվայել արտահայտություն կատարելով ոստիկանների նկատմամբ, շարունակել է իր ճանապարհը:

Ոստիկանության աշխատակիցները, կարծելով, որ վերջինս կապ ունի ստացված ահազանգի հետ և դրանով է պայմանավորված նրա պահվածքը,  շարժվել են նրա ետևից: Հասնելով և կանգնեցնելով քաղաքացու ավտոմեքենան՝ ոստիկաններից մեկը մոտեցել  է նրան, ներկայացել ի պաշտոնե և նրա կողմից դրսևորած վարքագծի կապակցությամբ պարզաբանում պահանջել: Վերջինս ի պատասխան՝ սեռական բնույթի հայհոյանքներ է հնչեցրել:

Այդ պահին ոստիկաններին  է մոտեցել  25-ամյա քաղաքացու  հայրը և հրել ոստիկանին՝  հայհոյելով, ապա,  գետնից վերցնելով քար, բռնություն գործադրելու սպառնալիքներ է հնչեցրել ոստիկանների նկատմամբ: Ոստիկանները, տեսնելով, որ  հայր և որդի խոչընդոտում են իրենց պարտականությունների կատարմանը, վերջիններից պահանջել են իրենց հետ գնալ ոստիկանություն, իսկ նրանք ի պատասխան ոստիկանների իրավաչափ և օրինական գործողություններին` շարունակել են իրենց ագրեսիվ պահել և սեռական բնույթի հայհոյանքներ հնչեցնել, որից հետո  25-ամյա քաղաքացին դիմել է փախուստի, իսկ նրա հայրը դիտավորությամբ ձեռքերով հարվածել է ոստիկաններից մեկի կրծքավանդակին:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ 25-ամյա քաղաքացուն և նրա հորը մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի (իշխանության ներկայացուցչի նկատմամբ բռնություն գործադրելը) 1-ին մասով: Նրանցից նկատմամբ որպես խափանման միջոց է կիրառվել ստորագրություն չհեռանալու մասին:

Նախաքննությունն ավարտվել է, և քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է դատարան:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
